The application filed by Sirius XM Radio Inc. (Sirius XM) for special temporary authority
(STA), IBFS File No. SAT—STA—20100217—00028, IS GRANTED. Accordingly, Sirius XM is
authorized for a period of 30 days commencing on February 17, 2010 to continue to operate its
satellite digital radio service in Haiti via the Sirius satellite network using an emergency channel
on the Sirius FM—5 geostationary satellite at the 96.0° W.L. orbital location, to provide
emergency radio broadcast programming on an unprotected non—interference basis in accordance
with the terms, conditions, and technical specifications set forth in Federal Communication
Commission (Commission) rules, and the conditions set forth below.

1. Sirius XM shall coordinate all of its operations so that no harmful interference shall be caused
to any other lawfully operating satellites or radiocommunication system. Sirius XM shall cease
operations immediately upon notification of such interference and inform the Commission in
writing immediately of such an event.

2. Sirius XM is required to accept interference from other lawfully operating satellites or
radiocommunication systems.

3. Any action taken or expense incurred as a result of operations pursuant to this special authority
is solely at Sirius XM‘ s own risk.

4. This STA may be terminated at the International Bureau‘s discretion, without a hearing, if
conditions warrant. Under no circumstances may the operation of Sirius XM‘s satellite digital
radio service in Haiti violate the terms of an international agreement or treaty. Sirius XM is
required to post and/or retain a copy of this authorization as required by the Commission‘s Rules.

5. This grant is issued pursuant to Section 0.261 of the Commission‘s rules on delegated
authority, 47 C.F.R. § 0.261, and is effective immediately.

     Sirius XM requests a 30—day extension of the special temporary authority it received on
     January 18, 2010 related to its provision of service to Haiti to assist with relief
     efforts following the recent earthquake.

    Sirius XM Radio Inc., Request for Extension of Special Temporary Authorization
             Related to Emergency Relief Efforts in Haiti, Call Sign 82710

Sirius XM Radio Inc. ("Sirius XM"), by its attorneys and pursuant to 47 CER. § 25.120,
hereby requests a 30 day extension of the Special Temporary Authorization ("STA") it
received on January 18, 2010 related to emergency relief efforts in Haiti.

The January 12, 2010 earthquake in the Caribbean caused tremendous damage to the
nation of Haiti, including disabling many means of mass communication. Shortly after
the earthquake, Sirius XM began discussions with the Commussion‘s International
Bureau, the U.S. Department of State, USAID, and other entities about how Sirius XM
could most productively assist in relief efforts. These discussions resulted in a plan under
which (1) Sirius XM would supply satellite radios which the State Department would
have delivered to Haiti; and (2) Sirtus XM would devote an audio channel on the Sirius
network exclusively to emergency communications intended to be received in Haiti. In
order to facilitate Sirius XM‘s participation in these efforts, Sirius XM requested special
temporary authority which the International Bureau granted on January 18, 2010.‘
Absent an extension, that STA will expire today, February 17, 2010.

Despite Sirius XM‘s willingness to assist in the earthquake relief effort, the State
Department has not yet finalized its logistical plan that would ship Sirius XM‘s radios to
Haiti and enable Sirius XM to commence providing these emergency communications.
However, the need for communicating emergency relief information remains strong and
Sirius XM continues to work with the State Department and other entities in the hope that
Sirius XM can soon provide a service that would assist the ongoing international relief
efforts underway in the Haitian community.

Sirius agrees to continue to comply with the same conditions imposed on its initial grant
of STA. In particular, Sirius XM will provide service on a non—protected, non—harmful
interference basis. This emergency channel will be made available on the Sirius network
using the Sirius FM—5 geostationary satellite at the 96.0° W.L. orbital location. This
satellite can provide adequate coverage to Haiti without any change to the satellite‘s
technical parameters already approved by the Commission. Accordingly, the public
interest would be served by granting Sirius XM a 30—day extension of its STA.
