Skynet Satellite Corporation (Skynet) is granted special temporary authority for a period
of 30 days, commencing March 6, 2009, to conduct in—orbit testing (IOT) with un—
modulated continuous—wave carriers aboard the Telstar 1 1N satellite (Call Sign: $2357)
at the 37.55° W.L. orbital location, subject to the following conditions:

        (1)     Skynet shall coordinate its IOT operations with all potentially affected
operating satellite networks to ensure that no unacceptable interference results from its
IOT operations. In particular, operations pursuant to this authorization shall be consistent
with the terms of coordination agreements with the operators of the following satellites:
Intelsat 903 at 34.5° W.L., Intelsat—3R at 43° W.L., NSS 806 at 40.5° W.L., and
HISPASAT 1C and 1D at 30° W.L.

       (2)     Skynet‘s operations shall not cause harmful interference to any lawfully
operating in—orbit satellites or radiocommunication system. Skynet shall cease operations
immediately upon notification of such interference.

         (3)     Skynet is required to accept interference from other lawfully operating in—
orbit satellites and radiocommunication systems.

        (4)    Aside from the use of continuous—wave carriers, operations pursuant to
this temporary authorization shall be consistent with all previously—authorized operating
parameters for Telstar 1 1N, including the assigned operating frequencies. See IBFS File
Nos. SAT—MOD—20011130—00118 (granted with conditions on Sept. 9, 2004) and SAT—
MOD—20060306—00024 (granted with condition on Dec. 11, 2007).

       (5)     This authority is granted pursuant to Section 0.261 of the Commission‘s
rules on delegated authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions
for reconsideration under Section 1.106 or applications for review under Section 1.115 of
the Commission‘s rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the
date of the public notice indicating that this action was taken.

Subject: Request for Special Temporary Authority to conduct In—Orbit Testing of the
         Telstar 1 1N Satellite (Call Sign $2357) at the 37.55° WL orbital position

Skynet Satellite Corporation (SSC) hereby requests Special Temporary Authority (STA),
beginning March 5, 2009‘, for a period of thirty (30) days to conduct In—Orbit Testing (IOT) of
the Telstar 1 1N satellite at 37.55° W.L. The in—orbit tests will be conducted on a non—
interfering basis.

The Commission has authorized SSC to operate Telstar 1 1N at 37.55° W.L.* After launch of
the satellite, IOT will be conducted using un—modulated CW test carriers at downlink EIRP
levels up to saturation, for short periods of time, for some tests. The saturation EIRP levels are
covered by SSC‘s authorization. SSC‘s authorization for Telstar 1 1N does not include
unmodulated CW signals. Accordingly, SSC requests an STA to operate unmodulated CW test
carriers during IOT.

SSC has already initiated coordination discussions with the operators of the affected
neighboring satellites: Intelsat, SES New Skies (New Skies), and Hispasat." Coordination with
Hispasat is complete. New Skies has indicated that it does not anticipate difficulties in
accommodating satellite testing. Intelsat is in the process of evaluating SSC‘s coordination
proposal and SSC anticipates that coordination will be completed prior to commencement of

IOT. SSC has no objection to an STA that is conditioned on successful completion of
coordination.                                   '

The earth station that will be used to transmit and receive IOT carriers is located at a teleport in
Allan Park, Canada, that is operated by SSC‘s parent company, Telesat (133438 Allan Park
Road, West Grey Township, Allan Park, ON N4N 3B, Canada, Telephone no. 519—364—1013).
For that reason, SSC is not requesting an IOT—related STA for any U.S. earth station.
