Orbital Location STATUS REPORT EchoStar Corporation ("EchoStar") submits a report on (1) the operating status of the EchoStar 3 satellite (including any change since June 30, 2008), and (2) the status of the replacement satellite for EchoStar 3. This report is being filed pursuant to conditions 4 and 5 on EchoStar‘s Special Temporary Authority to operate on the two unassigned DBS channels at the 61.5° W.L. orbital location.‘ EchoStar 3. The operating status of the EchoStar 3 satellite has not changed since EchoStar last reported on it on June 30, 2008. The latest Spacecraft Health Report for EchoStar 3 is attached as Confidential Attachment 1. Due to an anomaly during the fourth stage of the launch, however, the satellite has not reached its intended orbit and will not be deployed to the 61.5° W.L. orbital location. EchoStar has contracted with Space Systems Loral for the construction of EchoStar 15, a 32—transponder—capable DBS satellite that will effectively replace EchoStar 3 at 61.5° W.L." EchoStar 15 is expected to be ready for launch by the fourth quarter of 2010.
