The request of XM Radio Inc. (XM Radio) for special temporary authority (STA), IS
GRANTED for a period of 30 days, effective August 6, 2007. Accordingly, XM Radio is
authorized to operate the Telemetry, Tracking, and Command (TT&C) payloads of the XM—1
satellite (Call Sign $2118) during the drift from the 115.1° W.L. orbital location to the 85.2°
W.L. orbital location until September 5, 2007, subject to the technical specifications set forth in
its application, the Commission‘s rules, and the following conditions:

1.     XM Radio shall coordinate all drift orbit TT&C operations with other potentially affected
       in—orbit operators.

2.     During relocation of the XM—1 satellite, operations via the XM—1 shall be on a non—
       harmful interference basis, i.e., XM Radio shall not cause interference to, and shall not
       claim protection from interference caused to it by, any other lawfully operating satellites.

3.     In the event that any harmful interference is caused as a result of XM Radio‘s operations
       during the relocation of the XM—1 satellite, XM Radio shall cease operations immediately
       upon notification of such interference and shall inform the Commission in writing
       immediately of such an event.

                                       Attachment A

       XM Radio Inc. ("XM") hereby requests an extension of its Special Temporary

Authority ("STA"), for up to thirty days, to complete the drift of XM—1 from the

115.1°W.L. orbital location to the 85.2°W.L. orbital location, where it has permanent

authority to operate as an in—orbit spare.] XM‘s STA expires on August 6, 2007, but XM,

for the reasons stated herein, will not be able to complete the drift of XM—1 until

approximately August 15, 2007. As explained below, XM submits that the public interest

will be served by grant of this STA extension request.

       XM had originally scheduled the drift of XM—1 to begin on July 5th but has now

rescheduled the maneuver to begin July 16th. The two main reasons for changing the

anticipated start date are that setting up the XM—1 pre—drift thermal configuration and the

last steps in responding to the XM—3 temporary service outage also took longer than

expected. The process of returning XM—3 to a routine operational condition has been

ongoing since the service outage in May. The final step in this process was the restart of

automatic stationkeeping control. Additional time was needed to get the satellite‘s orbit

and momentum in the proper condition prior to the restart automatic control, which

occurred earlier this week. XM intends to use the additional time before the drift to

rehearse in more depth the procedures for the initiation of the drift activities, along with

rehearsing contingency procedures that cover certain potential anomaly situations.

       Additionally, XM now intends to use a 30—day relocation burn plan rather than the

original 20—day plan. This longer burn plan enables XM to be more conservative with

regard to avoidance of other in—orbit satellites, as well as providing XM better orbit

control in all stages of the drift. The longer burn plan also ensures more robust telemetry

coverage during the drift period. Since the public interest is best served by the safest

possible transition of XM—1 to its authorized orbital location, the FCC should grant this

STA extension request.

       Section 304 Waiver. in accordance with Section 304 of the Communications Act

of 1934, as amended, 47 U.S.C. § 304, XM hereby waives any claim to the use of any

particular frequency or of the electromagnetic spectrum as against the regulatory power

of the United States because of the previous use of the same, whether by license or

otherwise.
