Dear Bob:
I refer to the exchange of
letters between the FCC and Industry Canada on January 20, 2006 setting out our
informal understandings concerning certain technical issues involved in the
operation of the DirecTV 2 satellite.
We wish to inform you that we expect the DirecTV 2 satellite operations at the 91W orbital position will be terminated as earlier as May 1, 2007, once traffic has been moved from the to the DirecTV 1 satellite. Telesat Canada advises us that following the completion of traffic transfer, plans are underway to de-orbit the satellite from the 91W beginning on May 1, 2007.
In accordance with understanding 2 of our informal understandings, our view is that such de-orbiting activities would be subject to licensing by the FCC, and that this E-Mail constitutes advance written notice, pursuant to informal understanding 3.
