PanAmSat Licensee C o p ’ s (PanAmSat) request, IBFS File No. SAT-STA-20060628-00072
(Call Sign: S2146), to permit the GALAXY-9 satellite to remain at 90.9” W.L., as an in-orbit
spare until September 1,2006, following action on IBFS File No. SAT-MOD-20060425-00048
(Call Sign: S2146), IS GRANTED. During the period covered by the STA, GALAXY-9
operations will be limited to the tracking, telemetry, and command payload on the satellite.
Accordingly, PanAmSat is authorized to operate the GALAXY-9 satellite in accordance with the
terms, conditions, and technical specifications set forth in its application, this Attachment, and the
Commission’s Rules.

    1. Condition number 2 contained in the grant of IBFS File No. SAT-MOD-20060425-00048
        on June 29,2006, provided that “[tlhe GALAXY-9 satellite must be in operation at the
        74.15” W.L. orbital location within 90 days of grant or the authorization shall be null and
        void by its own terms. See 47 C.F.R. Section 25.161(c).” Grant of PanAmSat’s STA
        request here does not alter in any way the condition that GALAXY-9 be in operation at
        74.15’ W.L. within 90 days of June 29,2006.

    2. PanAmSat is afforded thirty days from the date of release of this grant and authorization
       to decline this authorization as conditioned. Failure to respond within this period will
       constitute formal acceptance of the authorization as conditioned.

    3. This Grant is issued pursuant to Section 0.261 of the Commission’srules on delegated
       authority, 47 C.F.R. tj 0.261, and is effective upon release. Petitions for reconsideration
       under Section 1.106 or applications for review under Section 1.115 of the Commission’s
       rules, 47 C.F.R. 95 1.106, 1.115, may be filed within 30 days of the date of the public
       notice indicating that this action was taken.

                   REQUEST FOR SPECIAL TEMPORARY AUTHORITY

        PanAmSat Licensee Corp. ("PanAmSat") has filed an application requesting that
the license for Galaxy 9 be modified to change the assigned orbital location for the
satellite from 90.9" W.L. to 74.14" W.L.1 Pursuant to Section 25.120 of the Commission's
rules,2 PanAmSat hereby requests special temporary authority ("STA"), following a
grant of the modification application and continuing through and including September
1,2006, for Galaxy 9 to remain at 90.9" W.L. During the period covered by the STA,
Galaxy 9 will serve as an in-orbit spare, and PanAmSat only will operate the tracking,
telemetry, and command ("TT&C") payload on Galaxy 9. PanAmSat will not operate
the commercial payload on the satellite during this time.

        Galaxy 9 has been serving as an in-orbit spare backing up PanAmSat's C-band
payloads in the portion of the satellite arc in the vicinity of 90.9" W.L. The payloads
backed up include the C-band payload on Galaxy 4R at 99" W.L. PanAmSat filed the
modification application to relocate Galaxy 9 to 74.15" W.L. as a response to the in-orbit
failure of Galaxy 3R, which was stationed at 73.95" W.L. PanAmSat will not be in a
position to release Galaxy 9 from its in-orbit spare duties at 90.9" W.L., however, until
Galaxy 4R, which has experienced operating anomalies, has been replaced by Galaxy
16. It is expected that commercial traffic will be handed off from Galaxy 4R to Galaxy
16 sometime in the month of August. Accordingly, PanAmSat is seeking an STA for
Galaxy 9 to remain at 90.9" W.L. through September 1. On or before the expiration of
the STA, Galaxy 9 will be relocated to 74.15" W.L. in accordance with the terms set forth
in the modification application.

        PanAmSat's request is supported by good cause. An STA will enable PanAmSat to
provide needed back-up to Galaxy 4R until the satellite can be replaced. Granting the
authority requested, moreover, would be in keeping with the Commission's policy to allow
"satellite operators to rearrange satellites in their fleet to reflect business and customer
considerations where no other public interest factors are adversely affected."3
