Accordingly, DIRECTV is authorized to continue to conduct Tracking, Telemetry, and Command (TT&C) necessary to maintain the DIRECTV 6 satellite as an in-orbit spare at the 109.5' W.L. orbital location for a period of 180 days2 in accordance with the terms, conditions, and technical specifications set forth in its application, the Commission's rules and this Attachment. 1. While maintaining an orbit at the 109.5' W.L. orbital location, DIRECTV shall not operate the main communications payload on DIRECTV 6. 2. All operations at the 109.5' W.L. orbital location shall be on a non-harmful interference basis, Le., DIRECTV shall not cause harmful interference to, and shall not claim protection from interference caused to it by, any other lawfully operating satellites or radio communication service. 3. In the event of any harmful interference as a result of DIRECTV's operations at the 109.5' W.L. orbital location, DIRECTV shall cease operations immediately upon notification of such interference and shall inform the FCC, in writing, immediately of such an event. 4. DIRECTV is afforded thirty days from the date of t h s action to decline this authorization as conditioned. Failure to respond within this period will constitute formal acceptance of the authorization as conditioned. 5. This action is used pursuant to Section 0.261 of the Commission's rules on delegated authority, 47 C.F.R. fj 0.261, and is effective upon release. Petitions for reconsideration under Section 1.106 or applications for review under Section 1.115 of the Commission's rules, 47 C.F.R. $9 1.106, 1.115, may be filed within 30 days of the date of the public notice indicating that this action was taken. ' The STA was placed on Public Notice as accepted for filing on Friday, April 14,2006. REOUEST FOR SPECIAL TEMPORARY AUTHORITY DIRECTV Enterprises, LLC (“DIRECTV”) requests an extension of its special temporary authority (“STA”) to continue operating its DIRECTV 6 satellite as an in-orbit spare at the 109.5’ W.L. orbital location for a total of up to 180 days. DIRECTV has been conducting TT&C operations only at this position pursuant to an STA granted last year,’ and requests authority to continue only those operations. DIRECTV anticipates that it will de-orbit this satellite before this STA has expired.
