EchoStar Satelite Operating Corporation‘s (*EchoStar®) request for specialtemporary authority (STA),
File No. SAT—STA—20060303—00021, IS GRANTED. Accordinely, EchoStar IS AUTHORIZED for a
period of60 days commencing on March 21, 2006,to conduct Tracking, Telemetry, and Command
(TT&C) necessary to (1)relocate ts EchoStar 10 satelitefrom is testing orbital location at 138.5° W.L.
to 110.2° WL. and (2)sttion the satelite at 110.2° W.L.(using only Telemetry, Tracking and Command
(TT&C) frequencies) in accordance withthe terms, conditions, and technical specifications se forth i ts
application,the Commission‘srules, and this Attachment
    1. Grant ofthis STA is without prejudice to action on EchoStar‘s pending appliation IBFS File No.
       SAT—LOA—20051221—00267 (Call Sign $2604)
       During the drifto and operation at 110.2° W.L., no harmful inerference shall be caused by
       EchoSiar to any other lawfully operating space sation or mdio communications system.
       In the event of ny harmfil interference as a result ofEchoStar‘s operations during the relocation
       to or stationing atthe 110.2° W.L. orbital lcation, EchoStar shall cease operations immediately
       upon notifation ofsuch interference and shall nform the FCC, in writing, immediately of such
       an event.
       EchoStar is required t acceptinterference from other lawfully operatig space sations or dio
       communications systems.
       Any action taken or expenseincurred as a result ofoperations pursuant to this special temporary
       authority is solely at EchoStar‘s own risk.
       EchoStaris prohibited from operating the communications payload of e EchoStar 10 satelite.
       EchoStar is afforded thity days from the date ofrelease of this action to declinethis authorization
       as conditioned. Failire to respond within this period will constitute formal acceptance of the
       suthorization as condiioned.
       This Grant iissued parsuant to Section 0.261 ofthe Commission‘s rles on delegated authority,
       47 CR § 0.261, and is effective immediately.

       By this application, EchoStar Satelte Operating Corporation (*EchoStar®) respectfully
requests specialtemporary authority (*STA") for a total period of upto 60 days starting on or
around March 21, 2006, to (1) move its EchoStar 10 satellite from itstesting orbita location at

138.5° W.L.to 110.2° W.L. and (2)station the satelite there (using only Telemetry, Tracking
and Command ("TT&C")frequencies) pending disposition of EchoStar‘s application for
permanent authorityto operate the satelite atthat location. Th 110.2° W.L.orbital location is

within the 110° W.L. DBS "cluster" assigned to the United States and already pending before the

Commission is an application for authority o operate the EchoStar 10 satellit using 10 ofthe 29
DBS frequencies already licensed to EchoStarat tht location.
      EchoStar emphasizes that tinstant STA request is only for authorityto use EchoStar
10‘s TT&C beacon for the purpose of moving and stationing the satellte, During the move from
138.5° W.Lto 110.2° W.., and while the satllit is stationed at 110.2° W.L., EchoStar 10‘s

communications payload (other than its TT&C payload) will be tumed off until such time as
EchoStar‘s application for permanent authority to operate the satelite at 110.2° W.L. is granted


by the Commission. The relocation oftsatellte will be coordinated with othersatllite

operators soas to avoid physical colliions and harmfulinterference from the use of TT&C

frequencies.
L      BACKGROUND
       EchoStar is currently operating two satelitesatthe 110° W.L. orbitallocation
EchoStar 8 is a spot— and CONUS—beam satellite operating on 20 ofEchoStar‘s 29 assigned
channels athe 110.0° W.L. orbital location." EchoStar 6 is a CONUS—beam satelite operating
on nine ofthose frequenciesatthe 110.2° WL. orbitallocation." EchoStar has requested
authorization to provide DBS service from 110.2° W.L. using the EchoStar 10 satelite."
Pursuant to Special Temporary Authority granted on February 3, 2006, EchoStar launched
EchoStar 10 tothe 138.5° W.L. orbital location for in—orbit testing. Testing is due to be
completed on or about March 21, 2006
       Once testing is completed, EchoStar plans to move the EchoStar 10 satllite t 110.2°
W.L. and tostation it there using TT&C frequencies only, pending the Commission‘s
consideration of EchoStar‘s application for operating authority. In addition, pursuant to separate
Commission authority thatis being requested, EchoStar plans to temporarily move EchoStar 6 to

110.35° W.L. to faclitate the traffic transfer operations among EchoStar‘s satelites that will be
conducted after operating authority for EchoStar 10 is granted."
1.     GRANT OPTIIS APPLICATION Ts IN ThE PUBLIC NTEREST
       ‘The Commission has a long—standing policy of granting Special Temporary Authority
where such authorization will not cause harmful interference and will serve the publicinterest,
convenience and necessity. See e /n the Marter ofNewcomb Communications, Inc., 8 CC
Red. 3631, 3633 (1993); /n the Marter ofColumbia Communications Corp., 11 FCC Red. 8639,
8640 (1996); in the Matter ofAmerican Telephone & Telegraph Co., Order, 8 ECC Red. 8742
(1993). In this case, both crteria are met.
       First, moving EchoStar 10 from itstesting location at138.5° W.L.will not cause harmful
interference to any other spacecraft because EchoStar willtum off al of ts communications
transponders with the exception of ts TT&C frequencies during the relocation. Furthermore,
EchoStar will coordinate with every operator that may be affected during the relocation.
Similarly, stationing EchoStar 10 at110.2° W.L.using only TT&C frequencies, and with the
satelite‘s main communications payload tumed off, will not cause any harmful iterference to
any other spacceraft®

       Relocating EchoStar 10 to 110.2° W.L..also serves the public interest a t will enable
EchoStar to move its satelit to its requested destination and provide expanded DBS service
from the 110.2° W.L. orbital location," and to expeditiously commence service upon grant of
EchoStar‘s application for operating authority. ‘The spot beam configuration ofthe EchoStar 10

satellite will allow EchoStar to employ greater spectrum reuse techniques in order to provide
bath more and improved advanced services t its subscribers. It also represents a critical
component of EchoStar‘s abilty to comply with the "single dish" requirement in the Satelite
Home Viewer Extension and Reauthorization Act.
       Accordingly, EchoStaris prepared to accept the following conditions on its request for
temporary authority fora total period of60 days to move EchoStar 10 to 110.2° W.L. and to
station it there pending disposition of EchoStar‘s application for operating authority:
       a) EchoStar will tim offall communications transponders with the exception ofits
          TT&C frequencies (1) during the relocation of EchoStar 10 from 1385° W.L. to
          110.2° W.L. and (2) while EchoStar 10 is stationed at 110.2° W.L. pending the grant
             of EchoStar‘s application ofoperating authority. In addition, EchoStar will coordinate
             its relocation operations with all potentially affected operating satellte networks.
       b) All TT&C operations for EchoStar 10 during its relocation and while it is stationed at
          110.2° WL.shall not cause harmful interference to any lawfully operating satelite
          network, and EchoStar will accept interference from any lawfully operating satelite
          network. In the event that EchoStar is notified ofany harmfulinterference during
          relocation or while the satelite is stationed at 110.2° W.L.,it will immediately inform
          the Commission, in writing, ofthe occurrence of such an event.
       ©) EchoStar shall notify the Commission in writing no late than seven days afte it has
             completed testing of EchoStar 10 and commenced moving EchoStar10 to 110° W.L..
u.     SECTION 304 waIVER
       In accordance with Section 304 of the Communications Act of 1934, 47 U.S.C. § 304,
EchoStar hereby waives any claim to the use ofany particular frequeney or ofhe
electromagnetic spectrum because of the previous use ofthe same, whether by license or
otherwise.

       For the foregoing reasons, and subject t the conditions above, EchoStar respectfully
requests specialtemporary authority to move and station EchoStar 10 at 110.2° W.L. for a total
period of60 days.
