Dear Ms. Dortch:
        On December 21, 2004, XM Radio Inc. ("XM"), a Satellite Digital Audio Radio Service
("SDARS®) licensee,fileda request for Special Temporary Authority ("STA") to test its S—
band/X—band replacement satellite (XM—3) at the 80.0°W.L. orbital location with an East—West
station keeping tolerance of £0.1° for a period of up to 60 days following launch. See File No.
File No. SAT—STA—20041221—00226. XM—3 is currently expected to be launched in the First
Quarter of 2005.
         As the request ofthe staff of the Interational Bureau ("Bureau"), XM hereby states that
it is not aware of any other FCC— or non—FCC—licensed spacecraft thatare operational or planned
to be deployed ator near the 80°WL orbitallocation whose station—keeping volume would
overlap with XM—3.
