Dear Ms. Dortch:

                Pursuant to Section 309(c)(2)(G) of the Communications Act of 1934, as
amended, 47 U.S.C. 0 309(c)(Z)(G), EchoStar Satellite Corporation (“EchoStar”) hereby requests
Special Temporary Authority (“STA”) to move its EchoStar 5 satellite from the 1 loo W.L.
orbital location to the 119’ W.L. orbital location and operate it over the channels licensed to
EchoStar at 119O W.L. for a period of 30 days pending the filing of a modification application to
allow regular operation. Specifically, EchoStar 5 would operate at the 119.05” W.L. orbital
location. Enclosed are an FCC Form 159 and a check in the amount of $145.00 to cover
applicable filing fees. Also enclosed is an additional copy, which we ask you date stamp and
return with our messenger.

                  EchoStar 5 is now located at the 110’ W.L. orbital slot. As a result of the recently
granted STA request to move EchoStar 6 to that location, and the successful completion of that
relocation, EchoStar 7, which uses all of the 21 DBS channels licensed to EchoStar at the 119O
W.L. orbital slot, now only has a single additional satellite as back-up. That single back-up
satellite is EchoStar 4, which is capable of using only a limited number of frequencies and may
have to be moved to a new orbital location. Furthermore, now that EchoStar 6 is successfully
relocated, EchoStar is satisfied that it does not now need a total of three satellites at 110” W.L.
EchoStar also believes that the combination of EchoStar 7 and EchoStar 5 at 119” W.L. and
EchoStar 8 and EchoStar 6 at 110” W.L. is at this point the most efficient allocation of these
satellites between these two orbital locations. Accordingly, EchoStar wishes to move EchoStar 5
to 119’ W.L. in order to ensure sufficient redundancy at 119” W.L. and, with the EchoStar 7
satellite, share the burden of EchoStar operations at that orbital location. EchoStar 5, a

1)   During the drift of the Echostar 5 satellite from the 110” W.L. to 119”
     W.L. orbital location, EchoStar Satellite Corporation (EchoStar) shall
     coordinate its TT&C operations with existing geostationary satellites to
     ensure that no unacceptable interference results from its TT&C operations;

2)   EchoStar shall not operate the communications payload of the EchoStar 5
     satellite while it is in drift;

3)   EchoStar shall coordinate use of EchoStar 5’s command frequency with
     DIRECTV pursuant to the letter from DIRECTV dated February 19,2003.

             REQUEST OF ECHOSTAR SATELLITE CORPORATION FOR
                      SPECIAL TEMPORARY AUTHORITY


               Pursuant to Section 309(c)(2)(G) of the Communications Act of 1934, as

amended, 47 U.S.C. 9 309(c)(2)(G), EchoStar Satellite Corporation (“EchoStar”) hereby requests

Special Temporary Authority (“STA”), for a period not to exceed 60 days, to operate an already

licensed transmit/receive earth station located in Cheyenne, Wyoming (an antenna licensed under

FCC call sign E950288) in conjunction with a satellite in the Direct Broadcast Satellite (“DBS”)

service, EchoStar 5, to be moved to the 119” W.L. orbital location and operated at that location.

EchoStar requests this 60-day authority pending the filing of a modification application for

regular authority to operate this earth station in conjunction with EchoStar 5 at 119” W.L. The

requested operation of this earth station in conjunction with EchoStar 5 - including for

Telemetry, Tracking and Command (“TT&C”) communications - will serve the public interest

because it will allow EchoStar to improve the efficiency of its satellite fleet deployment. At the

same time, the requested operation will not cause harmful interference into any authorized user

of the spectrum. By a companion request being filed today, EchoStar is applying for Special
