   Dear Mr.      Caton:

          On August 16,    1996,   this office,            on behalf of TEMPO
   Satellite, Inc. ("TEMPO"), filed a petition to deny the
   applications of EchoStar Satellite Corporation ("EchoStar") and
   Directsat Corporation ("Directsat") referenced above for
   temporary authority to use direct broadcast satellite frequencies
   allocated to TEMPO at 119° W.L.                On August 26,     1996,   EchoStar and
   Directsat responded to TEMPO‘s petition by filing a pleading
   styled as a "Joint Reply."

        Pursuant to Section 25.154(d) of the Commission‘s Rules,
   which by Public Notice Report No. SPB—53 (July 17, 1996)
   expressly governs the pleading cycle for the applications, TEMPO
   has the right to submit a reply pleading "within 5 days after the
   time for filing oppositions has expired unless the Commission
   otherwise extends the filing deadline...." Because the filing
   date for oppositions is August 29, 1996, TEMPO may file a reply
   by September 6, 1996.         See 47 C.F.R. §§ 1.4(g),            (h); 25.154(d).

       TEMPO assumes that the "Joint Reply" of EchoStar and
Directsat constitutes their opposition to TEMPO‘s petition.
Accordingly, this is to advise the Commission that TEMPO intends
to file a reply by September 6, 1996, to EchoStar and Directsat,
and to any other party filing a timely opposition.
