‘ Initially, the Satellite Division assigned Call Sign $2965 for the application from SES Gibraltar seeking U.S. market access
in the C—band for the SES—11 space station. See Policy Branch Information, Satellite Space Applications Acceptedfor Filing,
Public Notice, Report No. SAT—01169 (IBFS File No. SAT—PPL—20160512—00048). In order to facilitate recordkeeping, the
Division is associating both applications with a single Call Sign, $2964.
2 For the Ka—band frequencies, SES Americom seeks waivers of Section 25.210(f) and Section 2.106, footnote NG165. SES
Americom is not seeking operating authority for the Ka—band frequencies. Therefore, we will address the need for these rule
waivers in connection with any future request for operating authority in the Ka—band frequencies.

Operations under this grant must comport with the legal and technical specifications set forth by the
applicant or petitioner and with Federal Communication Commission‘s rules not waived herein. This
grant is also subject to the following conditions:

     1.   SES Americom must prepare the necessary information, as may be required, for submission to the
          International Telecommunication Union (ITU) to initiate and complete the advance publication,
          coordination, due diligence, and notification process of this space station, in accordance with the ITU
          Radio Regulations. SES Americom will be held responsible for all cost—recovery fees associated with
          ITU filings. No protection from interference caused by radio stations authorized by other administrations
          is guaranteed unless coordination and notification procedures are timely completed or, with respect to
          individual administrations, coordination agreements are successfully completed. Any radio station
          authorization for which coordination has not been completed may be subject to additional terms and
          conditions as required to effect coordination of the frequency assignments of other administrations. See
          47 CFR § 25.111(b).
          In connection with the provision of service in any particular country, SES Americom is obliged to comply
          with the applicable laws, regulations, rules, and licensing procedures of that country.
          SES Americom must operate SES—11 at the 104.95° W.L. orbital location in compliance with all existing
          or future coordination agreements for this location.
          SES Americom must maintain the SES—11 space station within an east/west longitudinal station—keeping
          tolerance of + 0.05 degrees of the 104.95° W.L. orbital location.
          The Commission has exchanged letters with the Office of Communications of the United Kingdom
          (Ofcom) to ensure a mutual understanding regarding the operations of the SES—11 space station. The
          Commission‘s letter to Ofcom is attached to this grant.* The understandings and factual basis for those
          understandings are material considerations for this grant of authority.
          The operations of SES—11 and associated earth stations in the Ku—band must comport with the applicable
          uplink and downlink limits in 47 CFR § 25.140(a)(3) of the Commission‘s rules, unless SES Americom
          coordinates any non—conforming operations with the operations of U.S.—licensed geostationary orbit space
          stations within 6 degrees of the 104.95° W.L. orbital location. SES Americom must also comport with
          the maximum power limits indicated in its application. Non—conforming operation must also be
          coordinated with respect to those operations of non—U.S.—licensed space stations within 6 degrees of
          104.95° W.L. involving approved communications with U.S.—licensed earth stations.
          Operation of SES—11 in the 14.47—14.5 GHz (Earth—to—space) frequency band is subject to the terms of
          footnotes 5.149 and US342 to the United States Table of Frequency Allocations, 47 CFR § 2.106, 5.149,
          US342, which urge applicants to take all practicable steps to protect the radio astronomy service from
          harmful interference.
          SES—11 must begin providing service at the 104.95° W.L. orbital location in the 11.7—12.2 GHz (space—to—
          Earth) and 14.0—14.5 GHz (Earth—to—space) frequency bands before the satellite it is replacing, AMC—15
          (Call Sign $2180), discontinues service at the 105.05° W.L. orbital location." Failure to meet this
          condition will render this authorization to operate in these frequency bands NULL and VOID.


* By communication of November 23, 2016, Ofcom confirmed its understanding of the informal arrangements described in
the attached letter.
5 SES Americom also requests a waiver of Section 25.165(a), 47 CFR § 25.165(a), if the Satellite Division determines that
SES—11 does not qualify as a replacement satellite pursuant to Section 25.165(e), which exempts replacement satellites from
the bond payment requirement. See 47 CFR § 25.165(e). Since SES—11 will operate in the same Ku—band frequencies as
AMC—15, we consider SES—11 to be a replacement satellite pursuant to Section 25.165(e). Therefore, SES Americom is not

    9. The license term for the space station is 15 years and will begin on the date that SES Americom certifies
         to the Commission that SES—11 has been successfully placed into orbit and its operations fully conform to
         the terms and conditions of this authorization. SES Americom must file its certification of
         commencement of operation with the Commission within five business days of SES—11 being placed into
         operation at the 104.95° W.L. orbital location.

     10. SES Americom‘s request for waiver of Section 25.210(i)(1) of the Commission‘s rules, 47 CFR §
         25.210(i)(1), is moot. This rule was eliminated as part of a recent Commission—level order streamlining
         Part 25 rules governing satellite communications. See Comprehensive Review ofLicensing and Operating
         Rulesfor Satellite Services, Second Report and Order, 30 FCC Red 14713, 14816—17, paras. 331—333
         (2015) (Part 25 Review Second R&O).

The following additional conditions apply to C—Band operations and the grant of file no. SAT—PPL—
20160512—00048:

     11. The grant of U.S. market access in the C—band does not include provision of any Direct—to—Home service,
         Direct Broadcast Satellite service, or Digital Audio Service to, from, or within the United States.

     12. Communications between U.S.—licensed earth stations and the SES—11 space station in the C—band must
         comply with all existing and future space station coordination agreements reached between the United
         Kingdom and other administrations.
     13. The operations of SES—11 to and from the United States and associated earth stations in the C—band must
         comport with the applicable uplink and downlink limits in 47 CFR § 25.140(a)(3) of the Commission‘s
         rules, unless SES Gibraltar coordinates any non—conforming operations with the operations of U.S.—
         licensed geostationary orbit space stations within 6 degrees of the 104.95° W.L. orbital location. SES
         Gibraltar must also comport with the maximum power limits indicated in its application. Non—
         conforming operation must also be coordinated with respect to those operations of non—U.S.—licensed
         space stations within 6 degrees of 104.95° W.L. involving approved communications with U.S.—licensed
         earth stations.
    14. This grant of market access will terminate in the event that the SES—11 space station is relocated from the
         104.95° W.L. orbital location or ceases to operate. In either case, SES—11 will be removed from the
         Permitted Space Station List. If SES Gibraltar seeks to provide service to the United States from the
         104.95° W.L. orbital location using another space station or seeks to operate SES—11 from another orbital
         location, it must file a new petition for market access to have the station placed on the Permitted List.
    15. SES—11 must begin providing service at the 104.95° W.L. orbital location in the 3700—4200 MHz (space—
        to—Earth) and 5925—6425 MHz (Earth—to—space) frequency bands before the satellite it is replacing, AMC—
         18 (Call Sign $2713), discontinues service at the 104.95° W.L. orbital location. Failure to meet this
         condition will render this grant of market access in these frequency bands NULL and VOID.

    16. SES Gibraltar‘s request for waiver of Section 25.210(i)(1) of the Commission‘s rules, 47 CFR §
         25.210(i)(1), is moot. This rule was eliminated as part of a recent Commission—level order streamlining
         Part 25 rules governing satellite communications. Part 25 Review Second R&0, 30 FCC Red at 14816—



required to pay a performance bond pursuant to Section 25.165(a). Similarly, we will not apply the bond requirement in
Section 25.165(a) to SES—11‘s U.S. market access authority for the C—band because SES—11 will operate in the same C—band
frequencies as the AMC—18 space station. In addition, with respect to the Ka—band frequencies, SES Americom is not
seeking operational authority and no such authority is granted. Thus, waiver of Section 25.165(a) is unnecessary.

Licensee/grantee is afforded thirty (30) days from the date of release of this action to decline the grant as
conditioned. Failure to respond within this period will constitute formal acceptance of the grant as conditioned.

This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47 CFR § 0.261,
and is effective upon release.

Station licenses are subject to the conditions specified in Section 309(h) of the Communications Act of 1934, as
amended, 47 U.S.C. § 309(h).

                                            Re: Operations of the SES—11 Satellite

Dear Mr. Neri:

       This letter is to confirm the informal understanding of the Federal Communications Commission
(FCC) and the Office of Communications (Ofcom), on behalf of the Gibraltar Regulatory Authority
(GRA), concerning the SES—11 satellite.
        The satellite is expected to be launched in the fourth quarter of 2016 and to operate at the 104.95°
W.L. orbital location. SES—11 is eapable of operating using the following frequencies: (1) the Ku—band
frequencies at 11.7—12.2 GHz (space—to—Earth) and 14.0—14.5 GHz (Earth—to—space); (2) the C—band
frequencies at 3700—4200 MHz (space—to—Earth) and 5925—6425 MHz (Earth—to—space); and (3) the Ka—
band frequencies at 18.3—19.3 GHz (space—to—Earth), 19.7—20.2 GHz (space—to—Earth), 28.35—29.1 GHz
(Earth—to—space) and 29.25—30.0 GHz (Earth—to—space). For telecommand, telemetry, and control
operations, the satellite will use the 14.0005 GHz, 14.0035 GHz, 14.4975 GHz, and 14.4995 GHz (Earth—
to—space), and 11.703 GHz and 12.1985 GHz (space—to—Earth), 3701.5 MHz and 4199.9 MHz (space—to—
Earth), and 5926 MHz and 5927 MHz (Earth—to—space) center frequencies.
         The SES—11 satellite is intended to supplement and replace capabilities on two satellites operated
by wholly—owned subsidiaries of SES Global, S.A. SES Americom, Inc. (SES Americom) will operate
SES—1 1 to supplement and, eventually, replace the Ku—band capacity of the AMC—15 satellite, which
currently operates at the 105.05° W.L. orbital location. SES Satellites (Gibraltar) Ltd. (SES Gibraltar)
will operate SES—11 to replace the C—band capacity ofthe AMC—18 satellite, which currently operates at
the 104.95° W.L. orbital location. In connection with the operation of SES—11, a satellite network filing
has been submitted to the ITU by Ofcom (on behalf of the GRA). The name ofthis satellite network is
GIBSAT Al.
       It is my understanding that our agencies have concurred onthe following technical issues
concerning the operation of the SES—11 satellite, contingent upon completion of the FCC licensing
process:
           1) At the 104.95° W.L. orbital location, operations of SES—11 in the C—band frequencies will be
              subject to the GRA‘s authority and such authority will allow the GRA to require SES
              Gibraltar to modify or cease operations in the C—band frequencies if deemed necessary.
           2) At the 104.95° W.L. orbital location, operations of SES—11 in frequency bands other than the
              C—band frequencies will be subject solely to the authority of the FCC. Operations of SES—11
              at any location other than 104.95° W.L., including operations in the C—band frequencies and
              any operations as a result of any equipment failure in the satellite that leads to inability to


              maintain the satellite within £+0.05° of its assigned 104.95° W.L. orbital location, will also be
              subject solely to the authority of the FCC.                               .
         3)   The FCC will retain the unilateral right in the event of extraordinary circumstances, to direct
              SES Americom to cease or modify operations of SES—11, or any portion of the satellite,
              without the need for consultation with or approval from Ofcom or the GRA, for example, to
              comply with a direction by the U.S. President under Section 706(c) of the Communications
              Act of 1934, as amended, 47 U.S.C. § 606(c), or in the event of a satellite anomaly presenting
              an imminent danger, and SES Americom will be required to comply with any such direction.
              It is understood that, if operations of SES—11 are ceased or modified under this condition, the
              FCC will inform Ofcom, at the earliest possible opportunity, about the action taken by the      _
              FCC.
        4)    The FCC will consult with Ofcom if practicable, prior to any relocation of the satellite from
              the 104.95° W.L. orbital location, or as soon thereafter as possible.
        5)    SES Americom and the FCC will be responsible for taking action necessary for compliance
              with the ITU Radio Regulations (in particular the coordination and notification procedures)
              for SES—1 1 at the 104.95° W.L. orbital location, except as noted in number 6 below.
        6)    SES Gibraltar, Ofcom, and the GRA will be responsible for taking action necessary for
              compliance with the ITU Radio Regulations (in particular the coordination and notification
              procedures) for SES—11 at the 104.95° W.L. orbital location in the C—band frequencies.
        7)    With respect to Paragraph 3.2 of the Minutes of the 13© Plenary Meeting of WRC—12 (as set
              out in ITU Circular Letter CR/333), the FCC will not object to Ofcom notifying the ITU of
              bringing into use the C—band frequencies of the GIBSAT Al network based upon the
              operations of SES—11.

        In addition, it is my understanding that the U.S. State Department will register the satellite with
the Secretary General of the United Nations, pursuant to the 1976 U.N. Convention on Registration of
Objects Launched into Outer Space.

        Any notices, inquiries, and correspondence from Ofcom concerning these matters should be
