CERTIFICATION I, Lincoln Oliveira, certify under penalty of perjury under the laws of the United States of America that: 1. I am the Director of Engineering and Vice President at Star One S.A. ("Star One") with knowledge of the construction status ofthe Star One C2 satellite. 2. To the best of my knowledge, information, and belief: a. Critical Design Review ("CDR") for the Star One C2 satellite was completed during meetings held between 8 March 2006 and 13 March 2006, at Alcatel Alenia Space (now named Thales Alenia Space). Attached are minutes from each day of those meetings that show the attendees, the matters discussed and the action items arising out of each meeting. See Attachment 1 (confidential). b. To date, Star One has paid to Thales Alenia Space approximately 90%of the amount due on completion of Payload and System CDR and approximately 80% of the total amount due under contract. A small proportion of the progress payments due have been withheld for a number of minor pending items that Thales Alenia Space is to address during the following months. c. Physical construction of the Star One C2 satellite has commenced. Attached is a photograph of the Star One C2 communications payload mated to the satellite bus. See Attachment 2 (confidential).
