Telesat Canada petitions the Commission for (1) a declaratory ruling confirming that use of Ka−band capacity in the 18.3−18.8 GHz, 28.35−28.6 GHz, and 29.25−29.5 GHz bands on Anik F2, a Canadian−licensed satellite, complies with U.S. market access policies, and (2) determine that the Ka−band portion of Anik F2 is two−degree compliant, such that the non− CERTIFICATION The Applicant waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the regulatory power of the United States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application. The applicant certifies that grant of this application would not cause the applicant to be in violation of the spectrum aggregation limit in 47 CFR Part 20. Telesat Canada petitions the Commission for (1) a declaratory ruling confirming that use of Ka− band capacity in the 18.3−18.8 GHz, 28.35−28.6 GHz, and 29.25−29.5 GHz bands on Anik F2, a Canadian−licensed satellite, complies with U.S. market access policies, and (2) determine that the Ka−band portion of Anik F2 is two−degree compliant, such that the non−interference condition previously imposed on the Ka−band U.S. operations of Anik F2 in the 19.7−20.2 GHz and 29.5−30.0 GHz frequency bands can be removed and no similar condition need be imposed on operations in the other portion of the band. 11
