Dear Ms. Dortch:
       1CO Satellite Services G.P. ("ICO®) requests that the above—referenced application
proceeding be designated as "permit—but—disclose" under the Commission‘s rules governing ex
parte communications.
       1C0 filed the above—referenced modification application and declaratory ruling petition
on January 10, 2005, and both filings were placed on public notice on February 4, 2005.". The
Bocing Company ("Bocing") subsequently filed comments on both the application and petition
        For ex parte purposes, the proceeding addressing the petition for declaratory ruling is a
"permit—but—disclose" proceeding under Section 1.1206(a)(3) of the Commission‘s rules, while
the modification application proceeding is "restrited" proceeding under Section 1.1208:‘ The

the public interest so requires."" Grant ofthis request will serve the public interest by allowing
the Commission to harmonize the expartestatus ofthe interrelated modification application and
declaratory ruling proceedings, and by facilitating communications with Commission stafft
