Petition for Reconsideration

Microcom, a DBS and broadband satellite distributor in Alaska and Hawaii, hereby
petitions the Commission to reconsider its ruling to allow Telesat and Wildblue to serve
the US market using the Ka band capacity on Anik F—2. The effect of this ruling will
result in the loss of broadband service to rural Alaska and Hawaii due to the probable
demise of Starband. Anik F2 Ka band transponders will cover only a small portion of
the Alaskan land mass and no portion of Hawaii. Starband currently provides full
coverage of both states. Wildblue and Telesat plan to provide higher access speeds for
less monthly cost than Starband made possible by the frequency reuse of Ka band
spectrum.    The subsequent market pressure placed on Starband could result in its demise
or sale of its subscriber base to Wildblue. We do not think it is sound public policy to
allow a foreign space station to result in loss of broadband services to Alaska and Hawaii
and do not think the Commission properly considered this impact in evaluating the
Telesat petition.

Specific Relief Requested

The Commission should place additional conditions on the use of the Anik F—2 satellite
Ka band capacity such that service to the United States cannot begin unless provisions are
made to prevent loss of consumer satellite broadband access in Alaska and Hawaii.
