While at the 169.0° E.L. orbital location, Horizons—3 License must maintain the Horizons 3e space station
with an east/west longitudinal station—keeping tolerance of +/— 0.05 degrees.
In connection with the provision of service in any particular country, Horizons—3 License is obliged to
comply with the applicable laws, regulations, rules, and licensing procedures of that country.
The U.S. Administration will not object to use of the Horizons 3¢e satellite by the Papua New Guinea
Administration for claiming bringing into use or continuing the use of orbital assignments at 169.0° E.L. in
the following frequency bands: 5850—5853.5 MHz, 10.85—10.95 GHz, 10.95—11.2 GHz, 11.2—11.45 GHz,
       12.2—12.25 GHz, and 12.92—13.25 GHz.*
Horizons—3 License‘s requests for waiver of sections 25.210(a)(3), and 25.210(i)(1) of the Commission‘s
rules, 47 CFR §§ 25.210(a)(3), and 25.210(i)(1), are moot. Section 25.210(a)(3) requires that space stations
in the FSS used for domestic service in the 3700—4200 MHz and 5925—6425 MHz frequency bands be
capable of switching polarization sense upon ground command. Section 25.210(i)(1) requires space station
antennas in the FSS to be designed to meet a cross—polarization isolation of at least 30 dB within the primary
coverage area of the antenna. Sections 25.210(a)(3) and 25.210(i)(1) were eliminated as part of a recent
Commission—level order streamlining Part 25 rules governing satellite communications."
Horizons—3 License‘s request for waivers of sections 25.202(a)(1) and 2.106 of the Commission‘s rules, 47
CFR §§ 25.202(a)(1) and 2.106, which allocate 12.2—12.7 GHz to Fixed Service (FS) and Broadcast Satellite
Service (BSS) in the United States, and 12.7—12.75 GHz to FS, Mobile Service, and FSS (Earth—to—space) in
International Telecommunication Union (ITU) Region 2, including the United States, is GRANTED on a
non—interference and non—protected basis. Horizons—3 License will operate Horizons 3¢ in these bands at the
169.0° E.L. orbital location in the space—to—Earth direction, which is in accordance with the Region 3
allocation for FSS, and thus conforms to the International Table of Frequency Allocations. Further, under
the ITU Region 2 BSS Plan, there is at least 15.8 degrees of orbital separation between Horizons 3e at 169.0°
E.L. and the nearest possible BSS network that could provide service to any portion of the ITU Region 2, so
it is unlikely that operations of Horizons 3¢e will interfere with any BSS networks in Region 2. Moreover,
Intelsat License LLC (Intelsat) was formerly authorized to operate its Intelsat 8 space station to provide FSS
at the 168.9° E.L. orbital location in the 12.25—12.75 GHz (space—to—Earth) frequency band, on a non—
interference, non—protected basis to any earth station in ITU Region 2.° Additionally, Horizons—3 License
will protect terrestrial station operations by complying with ITU PFD limits specified in No. 21.16 of the
ITU Radio Regulations. As a non—conforming user of the 12.2—12.75 GHz band in ITU Region 2, Horizons—

* Horizons 3e‘s operation in the frequency bands 12.75—13.25 GHz, 10.7—10.95 GHz, and 11.2—11.45 GHz bands have been
coordinated and notified under the ITU filings of the Administration of the United States‘ USASAT—101C and the
Administration of Papua New Guinea‘s NEW DAWN FSS—7. Horizons 3¢e‘s operation in the frequency bands 5850—5853.5
MHz, 10.95—11.2 GHz and 12.2—12.25 GHz will use the ITU filings of the Administration of the United States‘ USASAT—
60V and the Administration of Papua New Guinea‘s NEW DAWN 43. Horizons 3 requests that the United States
Administration state its non—objection to Papua New Guinea‘s use of Horizons 3¢e for purposes of bringing into use and
maintaining the NEW DAWN FSS—7 and NEW DAWN 43 filings. Application at unnumbered 6. Horizons 3 also states that
Horizons 3e‘s operations in the 3700—4200 MHz, 5925—6425 MHz, 12.25—12.75 GHz, and 14.0—14.5 GHz; 11.45—11.7 GHz;
and 13.75—14.0 GHz bands have been coordinated and notified under the Administration of the United States‘ ITU filings
USASAT—60J, USASAT—55L, and USASAT—55V, respectively. Id. We note that the U.S. Administration will not object to
use of the Horizons 3¢ satellite by the Papua New Guinea Administration for claiming bringing into use or continuing the use
of only those bands, or portions of bands, that are authorized for operation of the Horizons 3e space station at the 169.0° E.L.

3 License must not cause harmful interference to existing and future authorized users who are operating in
accordance with the Table of Allocations in ITU Region 2, and must accept interference from such
authorized users. In the event Horizons 3¢‘s operations in the 12.20—12.75 GHz band cause harmful
interference to any authorized service operating in accordance with the Table of Frequency Allocations,
Horizons—3 License must cease operations immediately upon notification of such interference and must
immediately inform the Commission, in writing, of such an event.
  7. Horizons—3 License‘s request for a waiver of the requirement in section 25.140 of the Commission‘s rules, 47
CFR § 25.140, to provide an interference analysis for the Appendix 30B frequencies of 10.85—10.95 GHz,
11.2—11.45 GHz, and 12.92—13.25 GHz is GRANTED." We agree with Horizons—3 License that at 169.0°
E.L., Horizons 3¢e will be at least 32 degrees from any U.S. Appendix 30B filing covering the 10.85—10.95
GHz 11.2—11.45 GHz, and 12.92—13.25 GHz frequencies, and that this will provide sufficient orbital
separation to ensure that Horizons 3e does not significantly degrade the interference environment for any
       other U.S. Appendix 30B location.
  8. Horizons—3 License‘s request for a waiver of section 25.210(f), 47 CFR § 25.210(f) of the Commission‘s
rules, in connection with Horizons 3e‘s use of the 10.85—10.922 GHz and 11.523—11.577 GHz bands is
GRANTED. Section 25.210(f) requires that FSS space stations employ full frequency re—use either through
orthogonal polarization in the same beam and/or the use of spatially independent beams. The purpose of the
rule is to ensure that space stations maximize the use of the spectrum. Horizons—3 License states that the
launch mass and power constraints on the satellite would have been exceeded had Horizons—3 License
included the necessary hardware that would have permitted full frequency reuse in these bands, and that this
spectrum consists of only 3.6% of Horizons—3 Licensee‘s total bandwidth. Granting Horizons—3 License a
waiver of section 25.210(f) would not prevent other licensees‘ use of the same spectrum through orthogonal
polarization, preserving the maximum utilization of the spectrum.
  9. Horizons 3°s request for a waiver of footnote US245 of the United States Table of Frequency Allocations, 47
CFR §2.106, US245, which states that use of the 5850—5925 MHz (Earth—to—space) frequency band for non—
Federal fixed—satellite service is limited to international inter—continental systems, is GRANTED. Horizons
3e‘s use of 5850—5853.5 MHz (Earth—to—space) for a command link from a U.S. earth station is an unpaired
Earth—to—space link, and thus cannot comply with US245. Use of the 5850—5853.5 MHz (Earth—to—space)
frequency band remains subject to case—by—case electromagnetic compatibility analysis in connection with
licensing of earth stations seeking to list Horizons 3e as a point of communication in this band. Horizons 3
must not claim protection from radiolocation service transmitting stations operating in accordance with
       footnote G2.
  10. The operation of Horizons 3e and associated earth stations must comport with the applicable uplink and
downlink limits in 47 CFR § 25.140(a)(3) of the Commission‘s rules, unless Horizons—3 License coordinates
any non—conforming operations with the operations of U.S.—licensed geostationary orbit space stations within
6 degrees of the 169.0° E.L. orbital location. The operations of Horizons 3e must also comport with the
maximum power limits indicated in its application. Non—conforming operation must also be coordinated
with respect to those operations of non—U.S.—licensed space stations within 6 degrees of 169.0° E.L.
involving approved communications with U.S.—licensed earth stations.
  11. Horizons—3 License‘s use of the 10.85—10.95 GHz (space—to—Earth), 11.2—11.45 GHz (space—to—Earth), and
12.92—13.25 GHz (space—to—Earth) frequency bands is subject to footnote 5.441 to the United States Table of
Frequency Allocations, 47 CFR § 2.106, 5.441, which states that operations in these bands shall be in
accordance with the provisions of Appendix 30B.

of footnotes 5.149 and US342 to the United States Table of Frequency Allocations, 47 CFR §2.106, 5.149,
US342, which urge applicants to take all practicable steps to protect the radio astronomy service from
    harmful interference.
15. Pursuant to footnote US337 of the United States Table of Frequency Allocations, 47 CFR § 2.106, US337,
any earth station in the United States and its possessions communicating with the Horizons 3e space station
in the 13.75—13.8 GHz (Earth—to—space) frequency band is required to coordinate through the National
Telecommunications and Information Administration (NTIA) Interdepartment Radio Advisory Committee
(IRAC) Frequency Assignment Subcommittee (FAS) to minimize interference to the National Aeronautics

                                              Horizons—3 License LLC
                                      IBFS File No. SAT—MOD—20170622—00093

discontinues service at the 169.0° E.L. orbital location. Failure to meet this milestone will render this
authorization to operate in these frequency bands NULL and VOID.®
  20. Horizons—3 License seeks to operate Horizons 3¢ in the 10.85—11.7 GHz (space—to—Earth), 12.2—12.25 GHz
(space—to—Earth), 12.92—13.25 GHz (Earth—to—space), and 13.75—13.997 GHz frequency bands that were not
authorized on either the Intelsat 805 or Intelsat 8 space stations, thus, Horizons—3 License was required to file
a bond for the additional frequencies it seeks to include in the Horizons 3e space station, pursuant to Section
25.165 of the Commission‘s rules, 47 CFR § 25.165.° Accordingly, this grant of authority in the 10.85—11.7
      GHz (space—to—Earth), 12.2—12.25 GHz (space—to—Earth), 12.92—13.25 GHz (Earth—to—space), and 13.75—
13.997 GHz frequency bands will become NULL and VOID, with no further action on the Commission‘s
part if Horizons—3 Licensee has not been launched to and commenced operations at the 169.0° E.L. orbital
       location by July 6, 2021.
  21. The license term for the space station is 15 years and will begin on the date that Horizons—3 License certifies
to the Commission that Horizons 3¢ has been successfully placed into orbit and its operations fully conform
to the terms and conditions of this authorization. Horizons—3 License is directed to file its certification of
commencement of operation with the Commission within five business days of Horizons 3e being placed
into operation at the 169.0° E.L. orbital location.
Licensee/grantee is afforded thirty (30) days from the date of release of this action to decline the grant as
conditioned. Failure to respond within this period will constitute formal acceptance of the grant as conditioned.

This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47 CFR § 0.261,
 and is effective upon release.

Station licenses are subject to the conditions specified in Section 309(h) of the Communications Act of 1934, as
 amended, 47 U.S.C. § 309(h).

8 This condition originally included the 12.25—12.5 GHz and 14.25—14.5 GHz frequency bands that were used on the Intelsat 8
space station (Call sign $2460), however, due to an emergency deorbit of Intelsat 8 on December 26, 2016, Horizons—3
License would not be able to fulfill its continuity of service obligation in these frequencies prior to the launch of Horizons 3¢e,
which is scheduled for the third quarter of 2018. See Letter from Cynthia J. Grady, Regulatory Counsel, Intelsat Corporation,
to Marlene H. Dortch, Secretary, FCC, IBFS File No. SAT—MOD—20151021—00073 (filed Dec. 28, 2016). The emergency
deorbit of Intelsat 8 constituted an unforeseen circumstance beyond Intelsat‘s control, and we find the public interest would
be served by removing these frequencies from this condition.
° On August 2, 2016, Horizons—3 License filed the bond for Horizons 3e with the Commission in the amount of $3,000,000,
pursuant to the procedures set forth in Public Notice, DA 03—2602, 18 FCC Red 16283 (2003).
