The application of Intelsat License LLC (Intelsat), IBFS File No. SAT—MOD—20130322—00052,
to modify the authorization for its Intelsat 10 space station (Call Sign $2382) is GRANTED.
Intelsat is authorized to operate Intelsat 10 from the 47.5° E.L. orbital location, instead of its
previously authorized orbital location of 68.5° E.L., to provide Fixed—Satellite Service (FSS) in
the 3700—4200 MHz (space—to—Earth), 5925—6425 MHz (Earth—to—space), 11.45—11.70 GHz
(space—to—Earth), 12.25—12.75 GHz (space—to—Earth), and 14.0—14.5 GHz (Earth—to—space)
frequency bands. Additionally, Intelsat is authorized to conduct telemetry, tracking, and
command operations necessary to maintain the Intelsat 10 space station at the 47.5° E.L. orbital
location using the center frequencies of 11.699 GHz, 12.7475 GHz, 12.7485 GHz, and 12.7495
GHz (space—to—Earth) and 14.0005 GHz and 14.4995 GHz (Earth—to—space). Operations under
this authorization must be in accordance with the terms and conditions contained in Intelsat‘s
application, the Federal Communications Commission‘s rules not waived herein, and are subject
to the following conditions:
         1.    Intelsat must maintain full operational control of the Intelsat 10 space station at all
times.
         2.    While at the 47.5° E.L. orbital location, Intelsat must maintain the Intelsat 10
space station with an east/west longitudinal station—keeping tolerance of +/— 0.05 degrees.
       3.      Intelsat must operate Intelsat 10 at the 47.5° E.L. orbital location in accordance
with any existing or future coordination agreements for this location.
       4.     In connection with the provision of service in any particular country, Intelsat is
obliged to comply with the applicable laws, regulations, rules, and licensing procedures of that
country.
         5.    This authorization is issued with the understanding that, to the extent Intelsat and
its affiliated companies, pursuant to any arrangement with the German Administration, conforms
its operations to any parameters agreed to in coordination agreements between the German
Administration and other Administrations, responsibility for both compliance with, and
enforcing compliance with, those arrangements and agreements is a matter that would arise
under private law.
        6.       This authorization is issued with the understanding that this grant is not an
approval of any specific arrangement entered into by Intelsat, its subsidiaries and affiliates, nor
of any specific provision of any such arrangement concerning operation of the Intelsat 10 space
station, nor is this grant an approval of an arrangement/agreement concerning any related matter,
nor of any specific provision of any such arrangement/agreement concerning any related matter.
        7.      The United States remains the licensing administration of the Intelsat 10 space
station and its communications payloads for purposes of International Telecommunication Union
(ITU) Radio Regulation 18.1 and is the Administration responsible for the operations of Intelsat
10. Any operations of Intelsat 10 at the 47.5° E.L. orbital location are pursuant to ITU Radio
Regulation 4.4. The U.S. Administration will not object to use of the Intelsat 10 satellite by the
German Administration for claiming bringing into use or continuing the use of orbital
assignments at 47.5° E.L. This grant does not in any way express a view concerning, or
agreement as to, the validity or lack of validity of any ITU filing at or within the vicinity of the
47.5° E.L. orbital location.

       8.      This authorization is issued with the understanding that, with respect to its filings
with the ITU for the 47.5° E.L. orbital location, the German Administration is not acting
pursuant to Article 9 of the Radio Regulations on behalf of the United States Administration.
        9.     Intelsat‘s use of the 11.45—11.7 GHz bands is subject to footnote US211 to the
United States Table of Frequency Allocations, 47 C.F.R. § 2.106, US211, which urges applicants
for airborne or space station assignments to take all practicable steps to protect radio astronomy
observations in the adjacent bands from harmful interference, consistent with footnote US74.
        10.     Intelsat‘s operation of the Intelsat 10 space station in the 11.45—11.7 GHz band is
limited to international operations in accordance with footnote NG 52 to the United States Table
of Frequency Allocations, 47 C.F.R. § 2.106, NG 52.
        11.    Use of the 12.25—12.70 GHz frequency band is not authorized in International
Telecommunication Union (ITU) Region 2.
        12.    Use of the 12.70—12.75 GHz frequency band is not authorized for FSS in the
space—to—Earth direction in ITU Region 2.
         13.    We grant the request of Intelsat License LLC for waivers of Sections
25.114(d)(14)(ii) and 25.283(c) of the Commission‘s rules, 47 C.F.R. §§ 25.114(d)(14)(ii) and
25.283(c). These rules require an applicant to demonstrate that all stored energy will be removed
at the spacecraft‘s end of life. Intelsat states that Intelsat 10 is a Boeing model 601HP spacecraft
that is not designed to vent all of its pressurized systems. Intelsat also states that following
launch of the Intelsat 10 spacecraft on May 15, 2001, two interconnected helium tanks on
Intelsat 10 were permanently sealed from other portions of the propulsion system by firing
pyrotechnic valves. This occurred on May 22, 2001. As a result, Intelsat states that at the end of
Intelsat 10‘s operational life, there will be helium remaining in the two—tank system that cannot
be vented. Intelsat states that Intelsat 10‘s two interconnected helium tanks have a combined
volume of approximately 88 liters, and that the residual helium in the two—tank system has a
mass of approximately 0.170 kg. We grant the requested waiver because Intelsat 10 was
launched before Section 25.283(c) became effective and compliance would require direct
retrieval of the spacecraft, which is not currently possible. In making this determination,
however, we note that the information submitted in the application is not sufficient to support a
finding that the intent of the rule would be satisfied by the described procedure for sealing the
pressurant tanks.
        14.    Intelsat must comply with the power levels specified in Section 25.212 of the
Commission‘s rules, unless it coordinates any operations using power levels exceeding the levels
in Section 25.212 with all potentially affected adjacent satellites within 6 degrees orbital
separation of the 47.5.° E. L. orbital location. Intelsat must inform the Commission of the power
levels it has coordinated.   In addition, Intelsat must inform all affected earth station operators
that Section 25.220 of the Commission‘s rules applies to operations that exceed the power levels
specified in Section 25.212. In no event shall the uplink input power spectral density level of
Intelsat 10‘s digital carriers operating in the 5925—6425 MHz and 14.0—14.5 GHz bands exceed —
38.7 dBW/Hz and —45 dBW/Hz, respectively. Further, in no event shall the downlink EIRP
density level of Intelsat 10‘s digital carriers in the 37004200 MHz band exceed —31.7 dBW/Hz.
Finally, in no event shall the downlink EIRP density level of Intelsat 10‘s digital carriers

operating within the 11.45—11.7 GHz, 12.25—12.5 GHz, and 12.5—12.75 GHz bands exceed —20.0
dBW/Hz.
        15.     Intelsat requests waiver of the requirement to meet milestones or post a bond for
operations at 47.5° E.L., pursuant to Sections 25.164(a) and 25.165 of the Commission‘s rules,
47 C.F.R. §§ 25.164(a) and 25.165. Because Intelsat 10 is in—orbit and already operating at 47.5°
E.L. pursuant to grants of special temporary authority,‘ grant of authority to operate Intelsat 10 at
47.5° E.L. is not subject to milestone conditions and Intelsat is not required to post a bond. As
such, waiver of Sections 25.164(a) and 25.165 of the Commission‘s rules is not necessary.
        16.     Grant of this authorization does not convey to Intelsat any authority to operate a
space station at the 47.5° E.L orbital location beyond the term granted herein, nor any status in
the United States satellite licensing process relative to applications for authority to operate a
regularly authorized satellite at this orbital position.
         17.      Grant of this modification application does not change the expiration date of the
authorization for Intelsat 10, which is July 2, 2016.
         18.     Grant of this authorization is without prejudice to any decision regarding Intelsat‘s
ability to file an application for authorization to operate a replacement space station in the 12.25—
12.50 GHz frequency band at the 68.5° E.L. orbital location." Grant of this authorization does
not constitute an announcement that this frequency is available for reassignment.
       19.     Grant of this authorization does not constitute a finding pursuant to Section
25.161(c) of the Commission‘s rules.
       20.    Intelsat is afforded 30 days from the date of release of this action to decline this
grant of market access as conditioned. Failure to respond within this period will constitute
formal acceptance of the grant as conditioned.
       21.     This action is issued pursuant to Section 0.261 of the Commission‘s rules on
delegated authority, 47 C.F.R. § 0.261, and is effective immediately.          Petitions for
reconsideration under Section 1.106 of the Commuission‘s rules or applications for
reconsideration under Section 1.115 of the Commission‘s rules, 47 C.F.R. §§ 1.106, 1.115, may
be filed within 30 days of the public notice indicating that this action was taken.

Commission, hereby seeks to modify the authorization for the Intelsat 10                      (call sign S$2382)
