The application of Intelsat License LLC (Intelsat), IBFS File No. SAT—MOD—20120605—00094,
to modify the authorization for its Intelsat 709 space station (Call Sign $2396), is GRANTED.
Specifically, Intelsat is authorized to operate Intelsat 709 in inclined orbit mode at the 47.5° E.L.
orbital location, instead of its currently authorized orbital position of 72.10° E.L., to provide
Fixed—Satellite Service (FSS) in the 3700—4200 MHz (space—to—Earth), 5925—6425 MHz (Earth—
to—space), 10.95—11.20 GHz (space—to—Earth), 11.45—11.70 GHz (space—to—Earth), 12.50—12.75
GHz (space—to—Earth), and 14.0—14.50 GHz (Earth—to—space) frequency bands.‘ Intelsat is also
authorized to perform telemetry, tracking, and command operations necessary to maintain
Intelsat 709 at the 47.5° E.L. orbital location using the center frequencies of 3947.5 MHz, 3948.0
MHz, 3952.5 MHz, and 3952.0 MHz (space—to—Earth); and 6173.7 MHz and 6176.3 MHz (Earth—
to—space)." Operations under this authorization must be in accordance with the terms and
conditions contained in Intelsat‘s application, as supplemented, the Federal Communications
Commission‘s rules not waived herein, and are subject to the following conditions:
     1.   All operations must be on an unprotected and non—harmful interference basis, .e., the
          Intelsat 709 space station must not cause harmful interference to, and must not claim
          protection from interference caused to it by, any other lawfully operating station. In the
          event of any harmful interference, Intelsat must cease operations immediately upon
          notification of such interference, and must inform the Commission, in writing,
          immediately of such an event.
    2. Intelsat must maintain its Intelsat 709 spacecraft with an east/west longitudinal station—
       keeping tolerance of + 0.05 degrees of the 47.5° E.L. orbital location.
    3. This authorization is issued with the understanding that, to the extent Intelsat and its
       affiliated companies, pursuant to any arrangement with the German Administration,
       conforms its operations to any parameters agreed to in coordination agreements between
       the German Administration and other Administrations, responsibility for both compliance
       with, and enforcing compliance with, those arrangements and agreements is a matter that
       would arise under private law.
    4. The United States remains the licensing administration of the Intelsat 709 space station
       and its communications payloads for purposes of International Telecommunication Union
       (ITU) Radio Regulation 18.1 and is the administration responsible for the operations of
       Intelsat 709. The U.S. Administration will not object to use of the Intelsat 709 satellite
       by the German Administration for claiming bringing into use or continuing the use of
       orbital assignments at 47.5° E.L. This grant does not in any way express a view
       concerning, or agreement as to, the validity or lack of validity of any ITU filing at or
       within the vicinity of the 47.5° E.L. orbital location.
    5. In connection with the provision of service in any particular country, Intelsat is obliged to
       comply with the applicable laws, regulations, rules, and licensing procedures of that
       country.

‘ Although the Intelsat 709 space station is capable of operating in the 11.70—11.95 GHz frequency band, it will not
use these frequencies at the 47.5° E.L. orbital location, and use of these frequencies is not authorized at this location.

180—day STA that was granted on June 13, 2012. See IBFS File No. SAT—STA—20120426—00076.

    6. Operations of Intelsat 709 in the 10.95—11.2 GHz and 11.45—11.70 GHz bands shall
       comply with the terms of footnote US211 to the United States Table of Frequency
       Allocations, 47 C.F.R. § 2.106, US211, which urges applicants for airborne or space
       station assignments to take all practicable steps to protect radio astronomy observations
        in the adjacent bands from harmful interference, consistent with footnote US74.
    7. Operations of Intelsat 709 in the 10.95—11.2 GHz and 11.45—11.70 GHz bands are limited
       to international operations in accordance with footnote NG104 to the United States Table
        of Frequency Allocations, 47 C.F.R. § 2.106, NG 104, and footnote 2 of Section
        25.202(a)(1) of the Commission‘s rules, 47 C.F.R. § 25.202(a)(1).
    8. Use of the 12.25—12.70 GHz frequency band is not authorized for FSS in International
        Telecommunication Union (ITU) Region 2.
    9. Use of the 12.70—12.75 GHz frequency band is not authorized for FSS in the space—to—
       Earth direction in ITU Region 2.
    10. Intelsat‘s request that the waivers originally granted to the Intelsat 709 space station,
        Sections 25.202(g), 25.210(a)(1), 25.210(a)(3), 25.210(i) and 25.211(a) of the
        Commission‘s rules, 47 C.F.R. §§ 25.202(g), 25.210(a)(1), 25.210(a)(3), 25.210(i) and
        25.211(a), continue to apply at the 47.5° E.L. location, is granted as conditioned in the
        2000 authorization."
    11. Intelsat shall comply with the power levels specified in Section 25.212 of the
        Commission‘s rules, unless it coordinates any operations using power levels exceeding
        the levels in Section 25.212 with all potentially affected adjacent satellites within 6
        degrees orbital separation of the 47.5.5° E. L. orbital location. Intelsat shall inform the
        Commission of the power levels it has coordinated. In addition, Intelsat must inform all
        affected earth station operators that Section 25.220 of the Commission‘s rules applies to
        operations that exceed the power levels specified in Section 25.212. In no event shall the
        uplink input power spectral density level of Intelsat 709‘s digital carriers operating in the
        5925—6425 MHz and 14.0—14.5 GHz bands exceed —38.7 dBW/Hz and —45 dBW/Hz,
        respectively. Further, in no event shall the downlink EIRP density level of Intelsat 709‘s
        digital carriers in the 3700—4200 MHz band exceed —32 dBW/Hz. Finally, in no event
        shall the downlink EIRP density level of Intelsat 709‘s digital carriers operating within
        the 10.95—11.2 GHz, 11.45—11.7 GHz, and 12.5—12.75 GHz bands exceed —20.0 dBW/Hz.
    12. Grant of this authorization does not convey to Intelsat any authority to operate a space
        station at the 47.5° E.L orbital location beyond the term granted herein, nor any status in
        the United States satellite licensing process relative to applications for authority to
        operate a regularly authorized satellite at this orbital position.
    13. Grant of this modification application does not change the expiration date of the
        authorization for Intelsat 709, which is July 18, 2016.

    authorization as conditioned. Failure to respond within this period will constitute formal
    acceptance of the authorization as conditioned.
15. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated
    authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration
    under Section 1.106 of the Commission‘s rules or applications for review under Section
   1.115 of the Commission‘s rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days
   of the public notice indicating that this action was taken.

     (§2396)     satellite.        Specifically,        this modification seeks permanent authority to relocate
     Intelsat     709   to,   and to operate the satellite in inclined orbit mode at,                                 47.5 E.L.
