                                   Response to Question 35
                                     Request for Waiver

                 ViaSat, Inc. (“ViaSat”) requests a modification of the authorizations for its
satellites at 115º W.L. (S2747) and at 77º W.L. (S2737) to allow ViaSat to reverse the order in
which the two satellites are implemented. ViaSat seeks a waiver or extension of the remaining
milestones for the 77º W.L. satellite to the extent the Commission deems it necessary to allow
that satellite to be deployed later than as currently provided under its remaining milestones.
ViaSat has indicated in response to Question 35 of the Form 312 for the 115º W.L. satellite that a
waiver is requested because the attached narrative references a waiver of milestones. Such a
waiver request, however, applies only to the 77º W.L. satellite.


                                  Response to Question 40
                      Description of Ownership; Officers and Directors

               As a publicly traded company, the stock of ViaSat is widely held. Based on
publicly available SEC filings, The Baupost Group, L.L.C. (“Baupost”) and affiliates
beneficially owned approximately 21.6 percent of ViaSat’s voting stock as of July 1, 2010.
Baupost is a limited liability company formed under the laws of the Commonwealth of
Massachusetts, and its address is 10 St. James Avenue, Suite 1700, Boston, Massachusetts
02116.

                In addition, and based on publicly available SEC filings, FMR LLC (better known
as “Fidelity Investments”) and affiliates owned approximately 11.12 percent of ViaSat’s stock as
of July 1, 2010. FMR LLC is a limited liability company formed under the laws of
Massachusetts, and its address of record is 82 Devonshire Street, Boston, MA 02109.

                                  Response to Question 42a
                                   Non-U.S. Space Station

               ViaSat’s authorization at the 115º W.L. location is for a non-U.S.-licensed space
station. ViaSat previously has provided, and the Commission has approved, the information
required by 47 C.F.R. § 25.137 for this satellite. See FCC File Nos. SAT-LOI-20080107-00006,
SAT-AMD-20080623-00131, SAT-AMD-20090213-00023 (granted Aug. 18, 2009).


                Waiver Pursuant to Section 304 of the Communications Act

               In accordance with Section 304 of the Communications Act of 1934, as amended,
and the Commission’s Rules, ViaSat waives any claim to the use of any particular frequency or
of the electromagnetic spectrum as against the regulatory power of the United States because of
the previous use of the same, whether by license or otherwise. See 47 U.S.C. § 304; 47 C.F.R. §
25.114(b).
