The application of SES Americom, Inc. (SES Americom), doing business as SES World Skies,
IBFS File No. SAT—MOD—20100324—00056, for modification of its authorization for its C— and
Ku—band AMC—2 space station (Call Sign $2134) is GRANTED. Accordingly, SES Americom
is authorized to operate AMC—2 at the 78.95° W.L. orbital location to provide Fixed—Satellite
Service, including Direct—to—Home service, using the 3700—4200 MHz (space—to—Earth), 5925—
6425 MHz (Earth—to—space), 11700—12200 MHz (space—to—Earth), and 14000—14500 MHz (Earth—
to—space) frequency bands. In addition, SES Americom is authorized to conduct Tracking,
Telemetry, Command, and Monitoring (TTC&M) operations necessary to relocate AMC—2 to
78.95° W.L. and to operate at 78.95° W.L. using the following center frequencies: 3700.5 MHz,
4199.5 MHz, 6423.5 MHz, and 12198 MHz. This authorization is granted in accordance with
the terms, conditions, and technical specifications set forth in SES Americom‘s application, the
Commission‘s rules not waived herein, and the following conditions:

    1. All operations during the drift to 78.95° W.L. shall be on an unprotected and non—harmful
        interference basis, i.e., SES Americom shall not cause harmful interference to any other
        lawfully operating station and shall not claim protection from interference caused to it by
        any other lawfully operating station.
   2. In the event of any harmful interference caused by AMC—2 during the drift to 78.95°
        W.L., SES Americom shall cease operations immediately upon notification of such
        interference, and shall inform the Commission, in writing, immediately of such an event.
   3. During the drift to the 78.95° W.L. orbital location, SES Americom may not operate
      AMC—2‘s communications payload.
   4. SES Americom shall prepare all necessary information that may be required for
      submission to the International Telecommunication Union (ITU) to initiate and complete
        the advance publication, international coordination, due diligence, and notification
        procedures for this space station, in accordance with the ITU Radio Regulations. SES
        Americom shall be held responsible for all cost recovery fees associated with these ITU
        filings. No protection from interference caused by radio stations authorized by other
        Administrations is guaranteed unless coordination and notification procedures are timely
        completed or, with respect to individual Administrations, by successfully completing
        coordination agreements. Any radio station authorization for which coordination has not
        been completed may be subject to additional terms and conditions as required to effect
        coordination of the frequency assignments with other Administrations. 47 C.F.R. §
        25.111(b).

   5. In connection with the provision of service in any particular country, SES Americom is
      obliged to comply with the applicable laws, regulations, rules, and licensing procedures
      of that country.

   6.   While at the 78.95° W.L. orbital location, SES Americom must maintain the AMC—2
        space station with an east/west longitudinal station—keeping tolerance of +/—0.05 degrees.

7. SES Americom is granted a waiver of Section 25.114(d)(3) of the Commission‘s rules,
   47 C.F.R. § 25.114(d)(3), which requires "[FJor applications for geostationary orbit
   satellites, [predicted space station antenna gain contour(s) for each transmit and each
   receive antenna beam and nominal orbit location requested] must be provided in the .gxt
   format." In Section 4.0 of the Technical Appendix, SES Americom states that it
   complies with Section 25.114(d)(3) except in one instance: "The gain characteristics for
   the global horn antenna are not provided as a .gxt file because the .gxt data is not
   available from the spacecraft manufacturer. Instead, gain versus off—set angle
   information is provided as a figure in Annex 1 to the Technical Appendix." We find that
   the information in the Annex 1 of the Technical Appendix, together with the
   characterization provided in Section 4.0 of the Technical Appendix of the application,
   fulfill the requirements of Section 25.114(d)(3).

   On our own motion, we waive Section 25.283(c) of the Commuission‘s rules, 47 C.F.R. §
   25.283, with respect to oxidizer that will not be vented at the satellite‘s end of life. SES
   Americom states that the tank containing this oxidizer was sealed shortly after the
   satellite‘s launch. AMC—2 was launched on January 30, 1997, before Section 25.283(c)
   was adopted. Accordingly, venting would require direct retrieval of the satellite, which is
   not currently possible. Waiver is granted conditioned upon SES Americom providing,
   through a supplemental filing within 30 days of the date of this grant, the volume and
   mass of remaining oxidizer in the tank and the volume of the tank.

   SES Americom has not requested approval of a post—mission disposal plan for the AMC—
   2 spacecraft and this authorization does not constitute approval of any such plan.

10. Grant of this modification application does not change the expiration date of the
   authorization for AMC—2, which is March 5, 2012.

11. SES Americom is afforded thirty days from the date of this action to decline this
    authorization as conditioned. Failure to respond within this period will constitute formal
    acceptance of the authorization as conditioned.

12. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated
    authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration
    under Section 1.106 or applications for review under Section 1.115 of the Commission‘s
   rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the date of the public
   notice indicating that this action was taken.
