Talens Counsel for ATCONTACT Communications , LLC 6017 Woodley Road McLean, VA 22101 Re: ATCONTACT Communications, LLC SAT—MOD—20060511—00056 and SAT—MOD—20080813—00155 (Call Sign $2346) Dear Mr. Talens: This letter refers to ATCONTACT Communications, LLC‘s (ATCONTACT) October 15, 2008 filing to demonstrate compliance with its milestone requirement to commence physical construction of its first non—geostationary satellite orbit (NGSO) satellite.‘ We find this filing to be insufficient to establish compliance with this milestone requirement and request additional information. Pursuant to its authorization, ATCONTACT was required to provide evidence that it had commenced physical construction for its first NGSO satellite by October 15, 2008 On this date, ATCONTACT submitted a certification that it "has commenced construction of its first NGSO satellite."" ATCONTACT also submitted a copy of a sales agreement for the purchase of certain satellite equipment. The agreement provides that the equipment purchased by ATCONTACT will be delivered in installments over a 10—month period commencing in February 2009. We find that ATCONTACT‘s certification and purchase of equipment, for delivery next year, fails to show that it has commenced physical construction of its first NGSO satellite. Accordingly, please describe with specificity, what types of hardware (e.g., propulsion hardware, satellite control hardware, satellite bus, etc.) are in production. Additionally, please describe what production has taken place to date and provide photo evidence of the current stage of production of the hardware. Please provide the photographs as attachments in your response. Please also explain what payments have been made under the payment plan that was provided in the contract execution milestone certification. ‘ Letter to Marlene H.
