Satellite CD Radio Inc., a wholly-owned subsidiary of Sirius Satellite Radio Inc., (“Sirius”) filed at the Commission on March 19, 2008 and on May 21, 2008, to modify its existing non-geostationary satellite orbit digital audio radio service authorization to allow the launch and operation of the non-geostationary FM-6 satellite. The File Numbers of the application are SAT-MOD-200803 19-00074 and SAT-MOD-20080521 -001 10. The Commission has assigned the space station a Call Sign of S2105 and an ITU Designation of USASAT-28M. Sirius requests that the Commission submit frequency coordination and notification information to the International Telecommunications Union (ITU) for the subject space station. Sirius hereby states that it is aware of and unconditionally accepts its responsibility to repay all ITU cost recovery fees associated with the required ITU submissions (Ref: FCC Public Notice DA 01-2435 dated October 19, 2001).
