In its submission, Globalstar and Open Range Communications, Inc. ("Open Range") proposed a specific target schedule for the deployment of MSS/ATC service under which customers subscribing to the companies‘ MSS/ATC service prior to the availability of the second—generation Open Range device will be offered the opportunity to exchange or upgrade their initial end—user device as soon as the second—generation Open Range device becomes available. This letter confirms that all such exchanges and upgrades, as applicable, will be offered to customers at cost without any profit to either Globalstar or Open Range.
