ViaSat, Inc. File No. SAT-MOD-20071204-00168 Attachment - Conditions of Authorization Call Sign S2737 May 21,2008 ViaSat, Inc.'s (ViaSat) application, File No. SAT-MOD-20071204-00168, is GRANTED.' Accordingly, ViaSat is authorized to use the 28.10-28.35 GHz frequency band for gateway uplink operations on a secondary basis for its Fixed Satellite Service (FSS) Ka-band space station, ViaSat-KA-1, at the 77.3" W.L. orbital location, in accordance with the terms and conditions of its initial authorizatioq2 the technical specifications set forth in its application, the Federal Communication Commission's (Commission's) rules, and this attachment. We also grant ViaSat's request to relinquish its authority to use the 29.25-29.5 GHz frequency band. As a result, ViaSat is now authorized to operate its Ka-band FSS space station using the 18.3-18.8 GHz (space-to-Earth), 19.7-20.2 GHz (space-to-Earth), 28.10-28.6 GHz (Earth-to-space), and 29.5-30.0 GHz (Earth-to-space) frequency bands. 1. ViaSat is authorized to use the 28.10-28.35 GHz (Earth-to-space), band on a secondary basis for gateway Earth station operations only. This band is designated on a primary basis to the Local Multipoint Distribution Service (LMDS). Rulemaking to Amend Parts 1,2,21, and 25 of the Commission's Rules to Redesignate the 27.5-29.5 GHz Frequency Band, to Reallocate the 29.5- 30.0 GHz Frequency Band, to Establish Rules and Policies for Local Multipoint Distribution Service and for Fixed Satellite Services, Third Report and Order, FCC 97-378, 12 FCC Rcd 22310 (1997). Accordingly, ViaSat's operations must be on an unprotected, non-interference basis relative to LMDS, in accordance with 47 C.F.R. § 2.105(~)(2).ViaSat shall not cause harmful interference to, nor claim protection from, authorized LMDS stations in the 28.10-28.35 GHz frequency band that are presently assigned, or that may be assigned in the future. ViaSat must terminate operations immediately upon notification of such interference. In addition, ViaSat may not claim protection from interference from LMDS stations authorized to operate in this band. 2. ViaSat is authorized to relocate its telecommand functions from the 29.25-29.5 GHz frequency band to two one-megahertz bandwidth carriers at the 28.597 GHz and 28.599 GHz center frequencies. 3. ViaSat has 30 days from the date of this grant and authorization to decline this authorization as conditioned.
