EchoStar Satellite Operating Corporation‘s (EchoSter) application‘to construct, lunch, and
operatea direct broadeast satelite (DBS), EchoStar 10 (Call Sign: $2694)" TBFS File No. SAT—
LOA—20051221—00267, as amended by IBFS File No. SAT—AMD—20060120—00007, and
EchoStar‘s subsequient modification request, IBFS File No. SAT—MOD—20060320—000231, to
locate the satellitatthe 110.2° W.L. orbital location ARE GRANTED. Accordingly, EchoStar
is authorized to operatethe EchoStar 10 DBS space stationat the 110.2° W.L. orbital location
with feederlinks (Earth to space) in the 17.3—17.8 GHz band on DBS channels 2—7, 9—27, 29, and
31, and service links (space to Earth)in the 12.2—12.7 GHz band on DBS channels 4, 12, 18, 20,
23, 25, 26, 27, 29, and 31‘ in accordance with the terms, conditions, and technical specifications
setforth in its application,the Federal Communication Commission‘s (Commission) rules, and
the conditions below.*
         1. EchoStar and DIRECTV have entered imto an operator agreement with respect to
servicelinks on channels 27, 29,and 31 on the EchoStar 10 satelite at the 110° W.L. nominal
orbital lcation.® Accordingly, this grant is conditioned upon EchoStar operating service link
channels 27, 29, and 31 at the 110.2° W.L. orbital location on the EchoStar 10 satelite in
conformance with the operator agreement. EchoStar will inform the Commission in writing via
Jettr to the Chief, Satelite Division, Intemnational Bureau, if the operator agreement expires by
its own terms ois cancelled by either partyt the agreement.

         2. EchoStar‘s request for waiver of Section 25.2100), of the Commission‘s rules, 47
C.F.R. § 25.210(), for the EchoStar 10 satelte located atthe 110° .L. nominal orital location,
18 GRANTED as conditined.. Section 25.2100) requires Fixed—Satelite Service (PSS) space
station antennas to be designed to meet a cross—polarization isolation of 30 dB within the primary
coverage area of the antenna." EchoStar indicates thatthe cross—polarzation isolation of some of
the antennas in EchoStar 10‘s primary coverage area will be less than the minimum 30 dB
required by the rules, and is a minimum of 24.6 dB for the feeder—link receiving antennas, which
operatein the FSS." This shontfill will not produce a significant increase in interference, except
to the applicant itself As a condition of the waiver, EchoStar shall claim no more protection
from interference from other licensed radiocommunication systems operating in accordance with
the Commission‘s rules than iis feeder—ink receiving antennas had met Section 25.210() ofour
rules. Grant of this waiver request is consistent with our precedent
        3. EchoStar‘s request for waiver of Section 25.215 ofthe Commission‘s rles, 47 CFR
§ 25.215, for the EchoStar 10 stelite located at 110.2° W.L.orbial lcation, 1S GRANTED as
conditioned." Section 25.215 requires DBS space station service link antennas to be designed to
meet a cross—polarization islation of 30 dB within tprimary coverage area of the antenna."
EchoStastates that the cross—polarization isoltion of some ofthe service—link transmitting
antennas ofthe EchoStar 10 sateltes primary coverage area is slightly lessthat the minimum 30
dB required by Section 25.515, and is a minimum of 28.8 dB for the service—Jink transmitting
antennas within the primary service area othe antennas covering U.S. tertory."" The
Commission has stated that lcensees may use cross—polarization isolation which is different from
that specified for the Region 2 BSS Plan ifthey demonstrate that such a difference does not result
in interference to other operational or planned systems, including U.S.—Jicensed systems." As a
condition of this waiver, EchoStar must coordinate the operations ofEchoStar 10 with other
potentally affected radiocommunicationsystems, and operate on a non—harmful nterference
basis with respect to any DBS space stations that ar in compliance with the cross—polarizaton
isolation requirement. Also,since thinte—system cross—polarization interference caused by
EchoStar 10 not meeting the requirements of Section 25.215 must be factored into EchoStar‘s
own link budgets, EchoStar shll not laim any more protection from interference from other
radiocommunication systems operating in accordance with the Commission‘s rules than ifit met
the requirements of Section 25.218.

                4.. EchoStar must maintain the EchoStar 10 satelite at110.2 deg. W.L. with +0.05
       degree longitudinal stationkecping. See 47 CER. §25.210()
                5.. Pursuantto Section 25.111(c)othe Commision‘s riles, 47 CJFR. §25.111(0),
       EchoStar shall provide the Commission with all information it requires in order to modify the
       Appendix 30 Broadeasting—Satelite Service Plans and associated Appendix 30A feeder—ink Plans
       to incorporate the charaeteristics ofthe Broadasting:Satellite Service space station of the
       EchoStar 10 satelite, USABSS—26, i accordance with the TTU Radio Regulations. EchoStar
       shall be held responsible for allcostrecovery feesassociated with these TTU flings. We also
       note that no protecton from interference caused by radio stations authorized by other
       administations is gvaranteed unless coordination and notieation procedures are timely
       completed or, with respect t individual administrations, by successfully completing coordination
       sereements. Any radio sttion authorization for which coordination has not been completed
       and/orfor which the necessary agreements under Appendices 30 and 30A have not been obtained
       may be subjectto additional terms and conditions as required to effect coordination or obtain the
       sureement of ther Administrations.
               6.. The 10—year lcense term for the EchoStar 10 satelite began to run on April 10, 2006
       and will expireon April9, 2016.
                7.. EchoStar is afforded thirty days from the date of release ofthi grant and
       suthorization to declinethis authorization asconditioned. Failure to respond within this period
