unprotected basis,relative to fixed stations (FS),to ts existing authorization‘ to operate the in—
orbit Fixed Satelite Service (FSS) C:and Ku—band INTELSAT 701 satelite (Call Sign: $2400) t
180° W.L. (180° EL1 GRANTED. Accordingly, Intelsat North America is authorized to
operate the INTELSAT 701 satelite at 180° WL. (180° EL) in order to provide domestic
service in the extended Ku—bands, 10.95—11.2 GHz (space—to—Earth) and 11.45—11.7 GHz (space—
to—Earth),in accordance with the terms, conditions, and technical specifications set forth in is
application, this Attachment and the Federal Communications Commission‘s (Commission)
Rules. This is in addition to Intlsat North America‘s continuing authority to provide protected
international service in the extended Ku—bands, 10.5—11.2 GiHfz and 11.45—11.7 GiHtz (space—to—
Earth),as well as protected intemational and domestic services in the C: and Ku— bands, 3625—
3700 MHz, 3700— 4200 MHz, and 11.7—11.95 GHtz (space—to—Earth); and 5850— 5025 Mitz, 5025—
6425 MHfe and 140—14.5 GHz (Earth—to—space).". Intelsat North America also has existing
muthority to operate the INTELSAT 701 satelite in the 12.52.75 GHz (spaceto—Rarth)
frequency band over Intemational Telecommunication Union (ETU) Regions 1 and 3. The
conditions ofIntelst North America‘s existing authorization otherwise remain unchanged.

                 (hat waiver of these rules would not undermine theit parpose because the waiver
                 involves only passive receive—only carth stations that are not capable ofcausing
                 interference into: fixed. stations operating in the same. frequeney band
                 Furthermore, because Itelsat has agreed to accept any level oiterference from
                 fixed stations intoits receive—only earth stations‘ operations in the extended Ku—
                 band," FS operators would not be required to coordinate their station operations
                 with the space station operetor‘s receive—only earth sations* operations. Under
                 (hese circumstances, we determine that an additiona! coordination burden is not
                 placed upon FS operators and thir abilty to expand service in the fature is not
                 restrited in any manner. Grant here as conditioned is consistent with prior
                 Commission precedent.®

        2)       Intelsat North America shall operate ts earthstations in the 10.95—11.2 GHz and
                 1145—11.7 GHz bands that provide domestic service on an unprotected, non—
                 interference basis relative to fixed stations and, s such, Itelsat North Americn
                 may not cause harmfulinterference to, or claim protéction from, fixed stations to
                 which frequencies in the 10.95—11.2 GHe and 11.45:11.7 GHz bands have cither
                 already assigned, orto which frequencies in the 10.95—11.2 GHz and 1145—11.7
                 GHz bands may be assigned at a latedate.
        3)       Intelsat North Americais required to inform its customers, in writing, including
                 end—users receiving service from resellers accessing capacity on the INTELSAT
                 701 satelite, hatthe service in the 10.95—11.2 GHz and 11.45—11.7 GHz bands
                 with regards to domestic service is being provided on an uncoordinated basis,
                 AND THAT the porential exits that future—icensed fixed stations may cause
                 harmful interference to these unprotected earthstations
        4)       Intelsat North America is afforded thity days from the date of release of this
                 actionto declinethis authoriztion as conditioned. Failure to respond within this

Intelsat wil provide these services only on a non—f   leference/non—protected basis, and

        Waiver of the Commission‘s rulesis warrat ied when "good cause"is shown." A

       The Commission previously has determin that these crteria were satisfed in
an identical walver request by EchoStar." Specifite   My, the Bureau found that wahing
NG 104 and footnote 2 of Section 25202(a)(1) we 1d not undermine the purpose of the
rules i the party seeking a waiver:(1) will be utitly i eatth stations that are receive—only
in these bands and thus ‘not capable of causing iferterence into FS stations* operating
in the bands; and (2) agrees to "accept any level     interference from FS stations* in
these bands.!*
       Intelsat satities these crteria. The carth t fatons operating in the 10.95—11.2
GHz and 11.45— 1.7 GHz bands served by INTEL AT 905 at 335 .5° E.L. (24.5° WL),
INTELSAT 7or at 307° EL. (65° WL),INTELSA             701 at 180° EL. (180° W.L.), and

INTELSAT 605 at 174° EL. (106° W.L), tke thosp to be used by EchoStar, willnot
transimi in these bands and Intelsat agrees to ac t any level of nterference into those
earth stations from FS stations in these bands. Ag Fordingly,the earth stations operating
in these bands pose no interference concemns wi respect to co—frequency FS stations.
       Grant of Intelsats waiver request, moreovi . wil have no impact on the potental
for interference from the INTELSAT 905, INTELSP iT T07,INTELSAT 701, and
INTELSAT 605 satelltes. The dounink transmisg fons of these satelites in the 10.95—

        Intelsat alo agrees to abide by the custorhe r notifeation requirements that the
Bureau imposed on EchoStar.® Intelsat wil nfor®y its customers in writng, including
any customers receiving end—user services from         elers accessing capacity on
inTELSAT 005 at 335.5° EL. (24.5° WL), iTE t zo7 ar sor® EL.(WLL),
INTELSAT 701 at 180° EL. (180° W.L) and INT            isat 60at 174° EL. (188° WL.),of
the potental forinterference from FS operations        he 10.95—11.2 GHz and 11.45—11.70

       Finally, a grant of Intlsat‘s waiver request   ill serve the public interest by
expaning the range of services that Intelsat can       fovide to the public. n partcular, a
grant wl enable Itelsat to make additonal capadi l availablein the 10.95—11.2 GHiz
and 11.45—11.70 GHiz bands for services to custofy irs in the United States.
11. conctusion
       For the reasons stated herein,grant of nt lat‘s waiver request wil serve the
puble interest without undermining the purposes the Commission‘s rules.
