unprotected basis, relative to fixed sttions (FS), t its existing authorization® to operate the in—
orbit Fixed SateliteService (FSS) C:and Ku—band INTELSAT 908 satelite (Call Sign: $2409) at
24.5° W.L. (335.5° EL) 18 GRANTED.. Accordinaly, Itelsat North Arericais authorized to
operate the INTELSAT 905 sutelite at 245° W.L. (335.5° EL) in order to provide domestic
servicein the extended Ku—bands, 10.95—11.2 GHz (space—o—Rarth) and 11.45—11.7 GHz (space—
to—Rarth),in accordance with the terms, conditions, and technical specifications set forth in its
application, this Attachment and the Federal Communications Commission‘s (Commission)
Rules. This is in addition to Intelsat North America‘s continuing authonty to provide protected
international service in the extended Ku—bands, 10.95—11.2 GHz and 11.45—11.7 GiHte (space—to—

                that waiver of these rules would not undermine their purp se because the waiver
                involves only passive receive—only earth stations that are hot capable of causing
                interference into: fixed. stations operating. in the s ime frequency band.
                Furthermore, because Intelsat has agreed to accept any le k ofiterference from
                fixed stations into its receive—only earth stations‘ operatio in the extended Ku—
                band," FS operators would not be required to coordinate Iir station operations
                with the space station operator‘s receive—only earth statigns‘ operations. Under
                these circumstances, we determine that an additional coof dination burden is not
                placed upon FS operators and thei abilty t expand serf ce in the future is not
                restricted in any manner. Grant here as conditioned i consistent with prior
                Commission precedent."

        3)      Intelsat North America is required to inform its customefs, in writig, including
                end—users receiving service from resellers accessing capsbity on the INTELSAT
                905 satelite, thatthe service in the 10.5—11.2 GHtz and 11.45—11.7 GHte bands
                with regards to domesti service is being provided on $n uncoordinated basis,

                   Intelsat North America LLC Request for Waiver

       Pursuant to Section 1.3 of the Commission‘srules,‘ Intelsat North America LLC
("Intelsat®) respectfuly requests waivers offootnote NG 104 of the U.S. Table of
Allocations‘ and footnote 2 of Section 25 202(a)(1) of the rules." Intelsat seoks these
waivers in order to provide domestic service in the U.S.in extended Ku—bands 10.95—
11.2 GHz and 11.45—11.70 GHe, on a non—interference basis, using the folowing
satelites: INTELSAT 905, operating at 398.5° E.L. (24.5° W.L), INTELSAT 707,
operating at 307° E.L. (63° WL},INTELSAT 701, operating at 180° E.L. (180° W.L),
and INTELSAT 605, operating at 174° EL. (186° WL.). As explained more fuly below,
there is good cause to waive these requirements and doing so would be consistent with
Commission precedent. Grant of hisrequest wil serve the public inferest by making
addtional capacity available for communications services, without undermining the
purpose of the Commission‘s rules *

       The Commission has previously granted Intelsat icenses to operate the folowing
satelites at their respective ortita locations: INTELSAT 905 at 335.5° E.L. (24.5° WL),
INTELSAT 707 at 307° EL. (63° W.L, INTELSAT 701 at 180° EL(180° W.L.) and

uplink in the 14.0—14.5 GHz frequency band, and in the downink in the 10.95—11.2 GHz,
11.45—11.7 GHfrequency bands. In addtion, INTELSAT 701 and INTELSAT 707 also
operate in the 11.7—11.95 GHz and 12.5—12.75 GHz (thelatter over Regions 1 and 3)
frequency bands
       The 10.95—11.2 GHz and 11.45—11.7 Gz bands are shared on a co—primary
basis between the fixed satelite service (‘FSS®) and the fixed serviee (FS‘). Footnot
NG104 of the Table of Allcations and footnote2 of Section 25.202(@)(1) of the
Commission‘s rules Imit tuse of the 10.95—11.2 GHz and 11.45—11.7 GHz frequency
bands to "inferational systems."* The Commission has interpreted this restrction to
mean that these bands may be used only to provide infemational service." The purpose
of NG 104 and footnote 2 of Section 25.202(a)(1) is to Imit the number of FSS earth
stations with which the co—pimary FS would need to coordinate."

INTELSAT 707 satelie, operating at 307° EL. (63° W.L, INTELSAT 701 satelite,
operating at 180° EL. (180° W.L), and INTELSAT 605 satelite, operating at 174" EL
(186° W.L.). These downink transmissions wil be paired wih un‘ transmissions,
respectively,in the 14.0—14.25 GHz and 14.25—14.5 GHz bands, which are not subject to
the "international onlrestriction of NG 104 and footnote 2 of Section 25.202(a)(1)"
Intelsatwil provide these services only on a non—interference/non—protected basis, and
therefore will not need to coordinate earth statons in the 10.05—11.2 GHz and 11.4—11.7
GHz bands wi FS stations

        The Commission proviously has determined that thase crteria were satisied in
an identical walver request by EchoStar."" Specificaly,the Bureau found that waiving
NG 104 and footnote 2 of Section 25 202(2)(1) would not undermine the purpose of the
tules i the party seeking a waiver:(1) wil be utitzing earth stations that are receive—only
in these bands and thus ‘not capable of causing interference into FS stations" operating
in the bands; and (2) agrees to "accept any levelof nterference from FS staions‘ in
these bands.!"
        Intelsat satities these crteria. The earth stations operating in the 10.95—11.2
GHz and 11.45— 1.7 GHiz bands served by INTELSAT 905 at 398.5° E.L. (24.5° W.L )
INTELSAT 707 at 307° EL. (63° WL),INTELSAT 701 at 180° EL. (180° WL),and
INTELSAT 605 at 174° E.L. (186° W.L., like those to be used by EchoStar,willnot
transimi in these bands and Intelsat agrees to accept any level ofinfeference into those
earth stations fom FS stations in these bands. Accordingl,the earth stations operating
in these bands pose no interference concerns wih respect to co—frequency FS stations.
        Grant of ntelsats waiver request, moreover, wl have no impact on the potentil
foriterference from the INTELSAT 905,INTELSAT 707, INTELSAT 701, and
INTELSAT 605 satelites. The downlink transmissions of these satelites in the 10.95—
11.2 GHiz and 11.45—11.7 GHbands already comply with the powerfux density imits
set out in the Commission‘srules for operation over the U.S.," and Intelsat does not
propose to alter any operational characterisics of these satelites following a grant ofits
waiver request.

        Intelsat also agroes to abide by the customer notfication requirements that the
Bureau imposed on EchoStar.® Intelsatwilinform its customers in writing,including
any customers recelving end—user services from resellers accessing capacity on
INTELSAT 905 at 335.5° E.L. (24.5° WL), INTELSAT 707 at 307° EL (63° WL),
INTELSAT 701 at 180° E.L. (180° W.L.) and INTELSAT 605 at 174° E.L. (186° W.L., of
the potential forinterference from FS operations in the 10.95—11.2 GHiz and 11.45—11.70
GHz frequency bands
       Finally, a grant of Intlsat‘s waiver requestwll srve the puble interest by
expanding the range of services that Intelsat can provideto the puble. In partcular, a
grant will enable Itelsat to make additonal capacy availablein the 10.95—11.2 GHiz
and 11.45—11.70 GHz bands for services to customersin the United States.
.      conctusion
       For the reasons stated herein, grant ofIntelsat‘s waiver request wil serve the
puble nterest without undermining the purposes of the Commission‘s rules
Accordingly, and for good cause shoun,Intelsat asks that the Commission grant his
waiver request,
