Washington, D.C. 20554 RE: DigialGlobe.Jnc; File No.: SAT—MOD—20040728—00151; Call Sign: 52129 Request for Public Notice of Milestone Completion Ladies and Gentlemen: Pursuant to Section 25.165(d) of the Commission‘s Rules, 47 CFR. §25.165(0), as clarified by Public Notice dated August 6, 2003, Procedure for Filing Bonds Pursuant to New Satellite Licensing Procedure (Report No. SPB—187, DA 03—2602) ("the 2003 Public Notice"), DigitalGlobe, Inc., hereby submits information sufficient to establish completion of milestones one, two and three for the above referenced system, as set forth in Section 25.164(b)(1)(2) and (3) ofthe Commission‘s Rules (47 C.FR. §25.164(b)(1)(2)(3). Thisinformation supplements and restates information provided in DigitalGlobe‘s "Request for Determination of Compliance with Satellite Implementation Milestones" filed with the Commission on October 24, 2005. By submission ofthis request, DigitalGlobe is requesting timely action on the narrow issue of confirmation of milestone completion for milestones one, two and three. In support of Milestone #1 and in accordance with 47 C.ER. §25.164 (c), please find enclosed as Appendix A a copy of the binding, non—contingent contract between DigitalGlobe, Inc. and Ball Aerospace, prime contractor, for construction of the WorldView satellite (the "Licensed System"). Please note that the Licensed System is being constructed as a result of award by the U.S. Government ofthe NextView Satellite Intelligence Program and certain portions ofthe construction contract are classified and have been redacted. The entire contractis considered by both parties to be confidential. In support of Milestone #2 and in accordance with 47 C.FR. §25.164(d), please find attached as Appendix. B correspondence dated July 6, 2004, from the National Geospatial— Intelligence Agency (°NGA") confirming that the Critical Design Review for the Licensed System was successfully completed on June 30, 2004. 1ommir1) Botina Eckere, General Gounse! ym $ vom Hacoumens DiGITALGLOBE ..imomonmomtrerrenonmm in support of Milestone #3, and in accordance with 47 C.F.R. §25.164(e), please find attached as Appendix C, () a certification from Ball Aerospace, the prime contractor, dated January 15, 2006, that satelite construction has commenced, and (1) correspondence from the NGA, dated December 6, 2004, confirming the construction milestones are being met and authorizing payment against completion of said milestones. DigitalGlobe, Inc., respectfully requests that the Commission promptly review the submitted information and issue public notice confirming completion of milestones one, two and three ("Milestone Public Notice"). In accordance with Section 25.165(d) ofthe Commission‘s Rules and the 2003 Public Notice, upon issuance of the Milestone Public Notice, DigitalGlobe, Inc. will reduce the bond currently posted from US§5,000,000 to USS2,000,000.
