SSC certifies that In—orbit Testing ("IOT")" is complete and that the operations of the satellite fully conform to the terms and conditions of the space station radio authorization. SSC certifies it has satisfied the milestone requiring that launch and commencement of operations occur by September 28, 2009." SSC requests that the Commission make a determination this milestone has been satisfied, thereby entitling SSC to a refund of the remaining amount on its performance bond.
