Hughes Network Systems, LLC FCC Form 312 Question 33 November 2009 Response To Question 33 BRH Holdings GP, Ltd. (“BRH”), the ultimate controlling entity of Hughes Network Systems, LLC (“Hughes”), is organized under the laws of the Cayman Islands. Because Hughes seeks to operate as a non-common carrier space station, Section 310(b) of the Communications Act does not apply. Nonetheless, as the license application requires a response to this question, the parties are providing this information here. Additional details concerning BRH and the ownership chain through which it controls Hughes are provided in the Response to Question 40 in this application and in FCC File No. SAT-T/C-20070904-00119, at Exhibits E & F, a transfer of control granted by the FCC last year (effective June 12, 2008).
