                 Dear Ms. Dontch:
                          On December 28, 2004, Spectrum Five LLC ("Spectrum Five") filed a
                 Petiion for Declaratory Ruling (‘Petition") requesting authority to provide Direct
                 Broadcast Satelite service to the U.S. market using two Netherlands—suthorized
                 satellites from the 114.5° W.L. orbital location. In the Petition, Spectrum Five
                 stated that ts proposal complied with the Commission‘s requirements for market
                 entry by a foreign—authorized satellte. Based on conversations with the
                 Commission‘s staf, Spectrum Five also noted in the Petition that certain additional
                 technical information would subsequently be provided. By this letter, Spectrum
                 Five advises the Commission that it intends to supplement its Petition with this
                 additional technical information by no later than February 18, 208. Spectrum Five
                 respectfully requests that the Commission hold the Petition in abeyance until the
                 supplement is filed.
