FCC Form 312, Response to Question 34

Question 33 of Form 312 asks whether the applicant, Skynet Satellite Corporation (“Skynet”), is
a corporation of which more than 25 percent of the capital stock is owned of record or voted by
aliens or their representatives or by a foreign government or representative thereof or by any
corporation organized under the laws of a foreign country. The question is intended to ascertain
whether the applicant complies with Section 310(b)(4) of the Communications Act, which
establishes a 25 percent limit on foreign ownership for companies controlling the licensees of
broadcast, common carrier, aeronautical en route, and aeronautical fixed licenses. Section
310(b)(4) is inapplicable to Skynet’s proposed satellite, because the satellite is not an
aeronautical en route or aeronautical fixed station and Skynet does not propose to provide
broadcast or common carrier service via the satellite.
