                                 Response to Question 42
                               Non-U.S. Operating Authority

               By this application, ViaSat, Inc. (“ViaSat”) seeks a radiofrequency license
from the Commission for the Ka-band telemetry transmitter and command receiver on the
ViaSat-1 satellite, as well as for the autotrack and downlink beacons. Because those
telemetry, tracking, and command (“TT&C”) elements will be U.S. licensed, ViaSat has
answered “No” to question 42a.

                As explained in greater detail in Exhibit E, ViaSat holds authority to serve the
U.S. market using the Ka-band communications payload on ViaSat-1. That communications
payload will be operated under the authority of the Isle of Man and, ultimately, the United
Kingdom. ViaSat-1 would be U.S. licensed with respect to its TT&C elements following
grant of the instant application.
