On August 8,2008, Spectrum Five, LLC filed a letter with the Federal Communications
Commission (“Commission”) entitled “Emergency Request for Clarification of Condition
on the Operation of the EchoStar 11 DBS Satellite at 110”W.L.” Letter from Todd M.
Stansbury, Esq., Wiley, Rein LLP, to Marlene H. Dortch, Secretary, Federal
Communications Commission, dated August 8,2008 (“Letter Request”). On August 18,
2008, the Satellite Division, on its own motion, designated the matter as “permit-but-
disclose” for purposes of the Commission’srules governing ex parte communications.
The Satellite Division finds that designating this matter as “permit-but-disclose”will
facilitate resolution of the issues raised. See 47 C.F.R. $6 1.1200(a’), 1.1206 and 1.1208
note 2. This action is without prejudice to any determination regarding the processing of
the Letter Request.
