        This letter refers to the above referenced application filed on March 2, 2007, for authority to
launch and operate a satellite using portions of the Ka—band at the 77° W.L. orbital location. At the time
this application was filed, the Commission had not announced that the 77° W.L. orbital location was
available for assignment.‘ Consequently, the application is premature and is dismissed without prejudice.
