EchoStar Satelite Operating Corporation‘s (EchoStar)application‘ to construct, launch, and
operate a direct broadcast satelite (DBS), EchoStar10 (Call Sign: $2694)" TBFS File No. SAT—

EchoStar‘s subsequent modification request, IBFS File No. SAT—MOD—20060320—00031, to
locate the satelite at the 110.2° W.L. orbiallocation ARE GRANTED, Accordingly, EchoStar
is authorized to operate the EchoStar 10 DBS space station at the 110.2° W.L. orbtal location
with feederlinks (Earth to space) in the 17.3—17.8 GHz band on DBS channels 2—7, 9—27, 20,and
31, and service links (space to Earh)in the 12.2—12.7 GHe band on DBS channels 4, 12, 18, 20,
23, 25, 26,27, 29, and 31° in accordance with the terms, condition, and technical specifications
set forth in its application,tFederal Communication Commissions (Commission) rules, and
the conditions below."
        1. EchoStar and DIRECTV have entered into an operator agreement with respect to
service links on channels 27, 29, and 31 on the EchoStar 10 sateliteat the 110° W.L. nominal
orbital location.®   Accordingly, this grant is conditioned upon EchoStar operating service link
channels 27, 29, and 31 at the 110.2° WL. orbial location on the EchoStar 10 satellte in
conformance with the operator agreement.. EchoStar will inform the Commission in writing via
leter to the Chief, Satelite Division, Intemational Bureau, if the operator agreement expires by
its own terms oris cancelled by cither party tothe agreement

         2. EchoStar‘s request for waiver of Section 2.210(), of the Commission‘s rules, 47
CFR. § 25.2100),forthe EchoStar 10 sateltelocated atthe 110° W.L. nominal orbial lcation,
15 GRANTED as conditioned. Section 25.210() requires Fixed—Satelite Service (FSS) space
station antennas to be designed to meet a cross—polarization isolation of 30 dB within the primary
coverage area of the antenna.® EchoStarindicates that the cross—polarization isolation of some of
the antennas in EchoStar 10‘s primary coverage area will be less than the minimum 30 dB
required by the rles, and s a minimum of 24.6 dB for the feeder—ink receiving antennas, which
operate in the FSS." This shortfll will not produce a significant increase in interference, except
to the applicant itsef.. As a condition of the waiver, EchoStar shall claim no more protection
from interference from other licensed radiocommunication systems operating in accordance with
the Commission‘s rulesthanif ts feederlink receiving anternas had met Section 25.2100) ofour
rules. Grant ofthis waiver request is consistent with our precedent

EchoStar sates that the eross—polarization isolation of some ofhe serviceink transmitine
antennas ofhe EchoSar 10 satelite‘s primary coverage area is slighty lessthat the minimum 30
dB required by Section 25.515, and is a minimum of28.8 dB for the servicelink transmiting
anternas within the primary service area of the antennas covering U.S. teritory."" The
Commission has stated thatlicensees may use cross—polarization isolation which is differentfrom
that specified for the Region 2 BSS Planifthey demonstrate that such a difference does not result
in interference to other operationalor planned systems,including U.S—licensed systems." As a
condition ofthis waiver, EchoStar must coordinate the operations of EchoStar 10 with other
potentiall affected radiocommunication systems, and operate on a non—harmfulintererence
basis with respect to any DBS space stations that are in compliance with the cross—polarzation
isolationrequirement. Also, sincethe inta—system cross—polarization interference caused by
EchoStar 10 not meeting the requirements of Section 25.215 must be fictored into EchoStar‘s
own link budgets, EchoStarshal not claim any more protection from interference from other
radiocommunication systems operating in accordance with the Commission‘s rules than if it met
the requirements of Section 25.215.

                 4.. EchoStar must maintain the EchoStar 10 satelite at 110.2 deg. W.L. with +/ 0.05
        degree longitudinal sationkeeping. See 47 CFR. § 25.210().
                 5. Pursuant to Section 25.111(c) f the Commission‘s rules, 47 CFR.§ 25.111(0),
        EchoSar shall provide the Commission with all information t requires in order to modify the
        Appendix 30 Broadcasting—SatelteService Plans and associated Appendix 30A feederink Plans
        to incorporate the characterstes of the Broadeasting—Satellte Service space station ofthe
        EchoStar 10 satelite, USABSS—26, in accordance with the TTU Radio Regulations. EchoStar
        shall be held responsible foall cosrecovery fees associated with these TTU flings. Wealso
        note that no protection frominterference caused by radio stations authorized by other
        administrationsis guaranteed unless coordination and notification procedures are timely
        completed or, with respectto individual administrtions, by successfully completing coordination
        sgreements. Any radio station authorization for which coordination has not been completed
        and/or for which the necessary agreements under Appendices 30 and 30A have not been obtained
        may be subject t additional terms and conditions as required to effectcoordination or obtain the
        agreement oother Administations.

                6. The 10—year liense term forthe EchoStar 10 satelite began to run on April 10, 2006
        and will expire on April 9, 2016.
                 7.. EchoStar is afforded thiny days from the date of release of this grantand
        authoriztion to decline this uthorization as conditioned. Failure torespond within this peiod
        will constiure formal acceptance ofthe authorization as conditioned.
                 8. This Grant is isued pursuant to Section 0.261 ofthe Commission‘s rules on
        delegated authority, 47 C.F.R. § 0.261, and is effective upon release. Petitions for
        reconsideration under Section 1.106 or applications for review under Section 1.115 ofhe
        Commission‘s rules, 47 CFR. §§ 1.106, 1.115, may be filed within 30 days ofthe date ofthe
        public noticeindieatig that this action was taken.
