        DIRECTV Enterprises,LLC (DIRECTV) has filed an application for authorityto launch and operate
a Fixed Satelite Service(FSS) Ka—band space station‘ on the proposed DIRECTV 98 Geostationary Sareite
Orbit(GSO) satelte, which is to b located atthe nominal101° WL. orbtal loction. For th reasons cited
below, we dismiss the application as defective, without prejudicet refiling.
        Section 25. 14(e)othe Commission‘s rules‘ requires all space station applicants t submit all
pplicable items oinformationlisted i ts subsections. In addition, Section 25.112(a)(1) of he
Commision‘s rules provides that an application will be unacceptable for filing if tapplcation is
defective withrespeet to completeness ofanswers t questions,informationalshowings, itermal
inconsistencies,execution,o other matters of formal characte."
         We find that DIRECTV‘s application contains inconsistencies regarding the effective isotropically
radiated power (EIRP) values ofthe space sation and the space sttion‘s compliance with the power fux
density limits of Section 25.208 of the Commission‘srules.* The applicationalso contains what appears to
be erroncous information concerning the uncoded data ratesfor the space sation‘s 36 megahertz and 54
megaherte cariers.
        Withrespectt the EIRP values,in Section 5.2.2 of Exhibit D of ts application, DIRECTV sttes
"t}he Ka—band payload of DIRECTV 98 has a maximum EIRP of 41.8 dBW per carvir." In addition, tem

In contrast, in Figure A2 of ExhibitD, DIRECTV provides a value o40.8 dBW for the entry labeled
"Satelite EIRP, dBW24 MHz" for a 36 megaherte—wide downlink carticr. Since 36 megaherte is
approximately 1.dBHz above 24 megahent, thi indicatestat the EIRP for a 36 meaaherts cartir is
approximately 42.6 dBW/36 megahent. Thus,the maximum EIRP stted in the link budget for he 36
megshertz downlink carier is inconsistent with the maximum per—cartie EIRP values stated in Section $.2.2
and Schedule S of the application. Also, in Figure A—3 ofExhibitD, DIRECTV provides a value of40.8
dBW for the entry labeled "Satllite EIRP, dBW/24 Mz" fora 54 megaherte—wide downlink carrier. Since
54 megahert is approximately 3.5 dBHz above 24 megshets, this indicates thatthe EIRP for a 54 meguhentz
carrier i approximately 44.3 dBW/S4 meesherte. Thus,the maximum EIRP stated in the link budgetforthe
54 megahert downlink carrier ialso inconsistent with the maximum per—carier EIRP values stated in
Section 5.2.2 and Schedule S ofthe application
         With respectto the power flux density limits, in tem S1(a)of Schedule S, DIRECTV has checked
the "N/A" box,indicating that the power—luxcdensity limts of Section 25.208 of the Commission‘s ules do
not apply to the proposed FSS space station. This is incorrect. However, DIRECTV sttes on pages 18—19 of
its Exhibit D that the proposed FSS space station complies with Section 25.208 and is thereforeinconsitent
with iem S17)of ScheduleS
        Finally, regarding what appears to be erroncous information concerning the uncoded data rites for
the space sttion‘s 36 megsherte and 54 megahentz carviers in item S1(e)of Schedule S, DIRECTV states
thatthe uncoded data ratefor the 24 megsherts carieis 30320 kbps and the uncoded data rates forthe 36
megsherte and 54 megaherts carviers are 45.48 kbps and 6822 kops, respectively. We note that th ratios
between the data rates and carier bandwidths forthe 36 megahertz and 54 megahertz carviers are extremely
low, and therefore the data rate listed mostlikely are erroncous. Therefore,if DIRECTV choosesto refile
its appliction, it should provide accurate data ratesfor the 36 meeaherte and $4 megahertz carrirs,or an
explanation for the extremely low data rates for these carriers
        For the above—mentioned reasons, we find DIRECTV‘s appliation to be ntermall inconsistent.
Accordingly, we fin thatthe application is defectve and thus unacceptableforfling. We therefore dismiss
the appliation (File No. SAT—LOA—20050822—00165), pursuant to Section 25.1 12(a)of the Commission‘s
niles?
