("SES Gibraltar") hereby notifies the Commission that the AMC—21 spacecraft commenced operations at 124.9° W.L. effective September 28, 2008. Accordingly, the condition specified in paragraph 2 of the grant of the above—referenced application relating to the AMC—21 satellite has been satisfied.‘ An affidavit attesting to the operational status of AMC—21 is attached hereto as Annex 1. ! See FCC Form 732, File No. SAT—ASG—20080609—00120, granted Aug. 6, 2008, at 2, requiring SES Gibraltar to demonstrate within 30 days of grant either that a performance bond was in place with respect to the spacecraft or that SES Gibraltar had satisfied the September 16, 2010 launch and operating milestone for the AMC—21 space station. The Commission subsequently grant—stamped a request for a 30—day extension of time to comply with this condition. See Letter from Karis A. Hastings to Ms. Marlene H. Dortch, File No. SAT—ASG— 20080609—00120 dated Sept. 4, 2008, grant—stamped Sept. 5, 2008.

ANNEX 1 DECLARATION OF JOHN NELSEN I, John Nelsen, Vice President, Business Operations, of SES Satellites (Gibraltar) Ltd., hereby certify under penalty of perjury as follows: The AMC—21 spacecraft was successfully launched on August 14, 2008. Following completion of in—orbit testing of the spacecraft at 136° W.L., the satellite was drifted to its assigned orbital location, 124.9° W.L.
