Attachment Terms and Conditions of Authorization September 16, 2005 1 SES Americom, Ic.‘s(°SES Americom") application, SAT—LOA—20050622—00133 and SAT—AMD—20050908—00175, Call Sign $2676, ARE GRANTED. Accordingly, SES Americom is authorized to launch and operate ts AMC—21 Ku—Band FSS satllt atthe 125° W.L. orbial location in the 11.7—12.2 GHz (space—to—Earth), and 14.0—14.5 GHe (Earth—to—space)frequency bands in accordance with the terms, conditions, and technicalspecifications se forth in its applications, this Attachment, and the Federal Communication Commission‘s (*Commission‘) Rules: 2. The AMC—21 satellite must be constructed. launched, and placed into operation in accordance with the technical parameters and terms and conditions of this authorization by these specified time periods following the date of authorization: Execute a binding contract for construction within one year (9/16/2006) sen o8 Complete the Critical Design Reviewwithin two years (9/1672007) Commence construction within three years (9/16/2008) Launch and begin operations within five years (9/16/2010) SES Americom mustfile a bond with the Commission in the amount of $3 million, pursuant to the procedures set forth in Public Notice, DA 03— 2602, 18 FCC Red 16283 (2003), within 30 days ofthe date ofthis grant (10/162005). Failure to meet any of these dates shall render this authorization null and void. See 47 CF.R. §§25.161 and 25.164. 3. SES Americom is authorized to provide directto—home services over the AMC—21 stellte, in the Ku—band, consistent with the rationale outlined in SES Americom, Inc. Applications for Modification of Fixed—Satellite Service Space Station Licenses, Order and Authorization, 18 FCC Red 16589 (2003). 4. SBS Americom shall prepare the necessary information, as may be required, for submission to the International Telecommunication Union (‘TTU®)t iniate and complete the advance publication, interational coordination, due diligence, and notification process ofthis space station, in accordance with the ITU Radio Regulations. SES Americom shallbe held responsible foallcost recovery fees associated withthese TTflings. We also note that no protection from interference caused by radio sations authorized by other administrations is awaranteed unless coordination and notifcation procedures aretimely completed or, with respect to individual administrtions, by successfully completing coordination agreements. Any radio station authorization for which coordination has not been completed may be subject to additional terms and conditions as required to effect coordination ofthe frequency assignments ofother administrations. See 47 CF.R. § 25.111(b)
