Dear Ms. Dortch:

        On August 6, 2009, the following parties participated in a meeting with Chip Fleming,
Diane Garfield, Fern Jarmulnek, Andrea Kelly, Cassandra Thomas, and Mark Young, all of the
International Bureau (“Bureau”): Stacy Fuller and Jack Wengryniuk of DIRECTV Enterprises,
LLC and William Wiltshire of Wiltshire Grannis LLP, on behalf of DIRECTV; David Bair of
EchoStar Corporation and Petra Vorwig of Steptoe & Johnson, LLP, on behalf of Echostar;
Susan Crandall of Intelsat North America LLC and Jennifer Hindin of Wiley Rein LLP, on
behalf of Intelsat; and Tony Lin of Pillsbury Winthrop Shaw Pittman LLP, on behalf of Pegasus
Development DBS Corporation. The parties discussed the application of the Commission’s
spectrum division rules, 47 C.F.R. §25.158(d), as described in the conditions to the 17/24 GHz
authorizations at the nominal 91°W, 99°W, 107°W, and 111°W orbital locations, referenced in
the attachment.

        The licensees understand that each licensee at a nominal orbital location is authorized to
use the entire 17/24 GHz allocation (i.e., the 17.3-17.8 GHz band (downlink) and 24.75-25.25
GHz band (uplink)), to the extent requested in the licensee’s respective application, subject to the
conditions specified in the authorization regarding division of spectrum and the frequency
selection process. Further, the parties understand that in the event a licensee surrenders or
forfeits its license, the remaining licensee(s) at that orbital location would continue to have the
right to use the entire 17/24 GHz allocation at that location, to the extent requested in such
licensee’s respective application, and the Bureau would make frequencies at that nominal orbital
location available for reassignment only if there were no remaining licensee(s) at that orbital
location authorized to use the frequencies.
