Dear Ms. Dortch:

EchoStar Satellite L.L.C. and EchoStar Satellite Operating Corporation (together
“EchoStar”) hereby notify the Commission of their intent to go forward with their
pending Reverse Band Working (17/24 GHz BSS) applications as required by the
Commission’s May 4, 2007 Order.’ That Order limits applicants to five pending Reverse
Band Working applications. As a result, EchoStar intends to proceed with the following
five applications:2

17.3-17.7 GHz Frequency Band and at the 17.7-17.8 GHz Frequency Band Internationally. and at the
24.75-25.135GHz Frequency Bandfor Fixed Satellite Services Providing Feeder Links to the Broadcasting-
Satellite Service and for the Satellite Services Operating Bi-directionally in the 17.3-17.8 GHz Frequency
Band, Report and Order and Further Notice of Proposed Rulemaking, FCC 07-76,n 146 (May 4,2007)
(“Order”).

         EchoStar reserves the right to modify these five applications upon release of the International
Bureau’s Public Notice seeking conforming amendments consistent with the Commission’s final rules in
this proceeding. Order, 9 145. At that time, “[a]pplicants can amend their choice of orbital location
consistent with our space rules.’’ Id. Prior to the release of that Public Notice, EchoStar encourages the
Commission to provide satellite carriers with additional flexibility as proposed in our May 29, 2007 filing
to maximize the consumer benefit from this new spectrum resource.
