Dear Mr. Horvath: Thank you for your submission of a copy of the contract requested pursuant to my letter of January 28, 2002. Please note that the filing of the contract by the February 8, 2002 date should not be construed as affirmative compliance with the commencement of construction milestone set forth in Astrolink International LLC‘s Ka—band authorization. The International Bureau will review the contract and determine whether the contract does indeed satisfy the commencement of construction milestone requirement. The Bureau will take action, by Order, if a licensee is found not to be in compliance with this milestone requirement. If the Commiussion does not take such action, licensees‘ public files will be updated to reflect that the milestone has been met. We expect to make these determinations in the next few months.
