Dear Mr. Wiltshire: On January 28, 2002, the Satellite and Radiocommunication Division requested certain information concerning the milestone obligations set forth in the Ka—band license granted to WB Holdings 1 LLC ("WB Holdings"). Specifically, we requested a copy of an executed contract verifying that construction has commenced on WB Holding‘s first satellite and that the satellite will be built within the time frame specified in the license. On February 8, 2002, WB Holdings submitted a copy of an executed contract with Space Systems/Loral, Inc. ("SS/L") as amended. One of the attachments in the submission was a letter of agreement, in which the parties agreed to a second standstill period during which neither party would exercise any right or remedy that it might be entitled to exercise under the underlying contract for the manufacture of a satellite. During this standstill period, which was to run until March 4, 2002, SS/L was not obligated to continue work on the satellite under contract and WB Holdings was not obligated to make any payments. After the standstill period ended, the parties were to be free to assert any claims, including defaults. ' The March 4, 2002, deadline has now passed. The continuing existence of an active contract is pertinent to our review of WB Holdings‘s compliance with its construction implementation milestone. Please submit an update as to the status of the contract between WB Holdings and SS/L. This information must be filed with the Commission‘s Secretary by March 29, 2002, with a hand delivered or electronic courtesy copy to Alyssa Roberts (aroberts@fee.gov) of my staff.
