SAT—LOA—19941116—00088; SAT—AMD—19950224—00033; SAT—AMD—19960223—00031; SAT—AMD—19960819—00107; SAT—AMD—19971030—00175 Dear Ms. Dortch: On behalf of New York Satellite Industries, LLC ("NYS"), I am filing a copy of the attached letter received today from the U.S. Department of State‘s Director of the Bureau of Political—Military Affairs Directorate of Defense Trade Controls Office of Defense Trade Controls Licensing to Mr. Jan Friis, of Final Analysis Communication Services, Inc. ("FACS") with a request for confidential treatment pursuant to 47 CRF §§ 0.457(d) and 0.459 for confidential treatment. Through the State Department‘s letter, the Office of Defense Trade Controls Licensing approves FACS‘ request for a Technical Assistance Agreement ("TAA") with PO Polyot of Russia, with standard and appropriate provisos. Due to this instant approval, FACS is now in a position to discuss a schedule with Polyot for construction and launch of the satellites in the FAISAT system. FACS will therefore be able to provide the FCC‘s International Bureau firm dates for a milestone extension request in the near future. WREFMAIN 12075255.1

May 14, 2003 Page 2 In securing the release of this approval today, FACS argued forcefully to State Department that timely approval of the TAA was critical for FACS to maintain its license in good standing with the FCC. NYS hopes that the Bureau will consider the credence the State Department placed in FACS, as well as these efforts to expedite the release, as the Bureau considers the issue of the disposition of FACS® waiver request. In the interest of providing this information to the Bureau in the most timely manner, NYS is filing this letter and confidential attachment today.
