                                 PETITION TO DENY


Opposition Comments of Robert D.           Augsburg,    President of Southwest

Florida Community Radio Inc. pursuant to the Public Notice released

October 13,    1992,    herewith submits comments in opposition to the

allocation of 2310—2360 mhz for satellite broadcast and application

of any party for the use of that frequency band including Satellite

CD Radio Inc.    (CD Radio) which is under consideration by the

Commission in the above referenced proceeding.            In support,   I submit

the following:



I ask the Commission to deny the rights of organizations to bring

Satellite radio to the consumer because of the tremendous adverse

effect it will    have on the local        broadcaster.    In my associations

with other broadcasters,        there is no question that this technology

will   greatly hinder and even cause many stations to cease

operations .


It is   just too difficult to operate a fulltime local

broadcast station in todays economy.       The addition of Satellite

radio signals to homes and automobiles will        in my opinion and

the opinion of thousands of other broadcasters,         will   be disas—

terous.     Simply put,   localism will not be able to survive with

the addition of Satellite delivered CD Radio,         particularly in

markets where competition is already intense.



Please consider the interests of us small         local broadcasters

and not the interests of a select few large monopolies who will

be the only ones to benefit from Satellite CD Radio.           Stations

like ours will     greatly suffer and perhaps will    not be able to

survive should Satellite CD Radio come to be a reality.

Instead,     please channel   this new digital   technology so it can

benefit and enhance the local       broadcasting radio station and

thereby preserve localism.
