(‘EchoStar®) and Cablevision Systems Corporation and Rainbow DBS Company LLC (collectively "Rainbow DBS"),the undersigned hercby request expedited consideration of the above—referenced applications. On January 28, 2005, the applicants fled this Consolidated Application with the Commission, along with a related request for special temporary authorization. The only formal opposition to this application was fled on March 28, 2005, jointly by VOOM HD, LLC and The Association of Consumers to Preserve and Promote DBS Competition (*Association"). See Joint Petition to Deny. The applicants filed a joint opposition to this Petition on April12, 2005. See Opposition to Joint Petition to Deny. The Joint Petition to Deny has now been withdrawn by VOOM HD, LLC and the Association, as evidenced by the attached letter. See Letter to Marlene H. Dortch from Charles F. Dolan and Jerome J. Sandler (April 29, 2005). While a number ofinformal comments and correspondence from the public were submitted in this proceeding, the vast majority state that their opposition is based on a desire to continue to receive the VOOM service. As indicated in the Opposition to Joint Petition to Deny, the Cablevision Board has confirmed its decision to discontinue the provision ofthe VOOM service, and that decision is not affected by the sale ofthe assets that are the subject ofthis proceding.
