The application of DIRECTV Enterprises, LLC (DIRECTV), IBFS File No. SAT—LOA—
20120316—00051, as amended by IBFS File No. SAT—AMD—20120420—00071, to construct,
launch, and operate DIRECTV KU—79W (Call Sign $2861), a 12/14 GHz—band geostationary—
satellite orbit space station at the 79° W.L. orbital location, IS GRANTED.!‘ Accordingly,
DIRECTV is authorized to operate the DIRECTV KU—79W space station at the 79° W.L. orbital
location to provide Fixed—Satellite Service (FSS) in the 11.7—12.2 GHz (space—to—Earth) and
14.0—14.5 GHz (Earth—to—space) bands. DIRECTV is also authorized to conduct telemetry,
tracking, and command (TT&C) operations necessary to maintain DIRECTV KU—79W at the 79°
W.L. orbital location using frequencies centered on 11.704 GHz and 11.705 GHz (space—to—
Earth) and on 14.005 GHz and 14.495 GHz (Earth—to—space). DIRECTV‘s operations are subject
to the technical specifications set forth in DIRECTV*‘s application, the Federal Communications
Commission‘s rules, and the following conditions:

     1. DIRECTV shall prepare the necessary information, as may be required for submission to
the International Telecommunication Union (ITU), to initiate and complete the advance
publication, international coordination, due diligence, and notification process for this space
station, in accordance with the ITU Radio Regulations. DIRECTV shall be held responsible for
all cost—recovery fees associated with ITU filings. No protection from interference caused by
radio stations authorized by other administrations is guaranteed unless coordination and
notification procedures are timely completed or, with respect to individual administrations, by
successfully completing coordination agreements. Any radio station authorization for which
coordination has not been completed may be subject to additional terms and conditions as
required to effect coordination of the frequency assignments with other administrations. See 47
C.FR. § 25.111(b).

    2. In connection with the provision of service in any particular country, DIRECTV is
obliged to comply with the applicable laws, regulations, rules, and licensing procedures of that
country.

    3. DIRECTV shall operate the DIRECTV KU—79W space station at the 79° W.L. orbital
location in compliance with all existing and future coordination agreements.

   4. DIRECTV shall maintain its space station within an east—west longitudinal station—
keeping tolerance of +0.05° of its assigned 79° W.L. orbital location.

    5. DIRECTV‘s request for a waiver of Section 25.114(c)(9) of the Commission‘s rules, 47
C.FR. § 25.114(c)(9), is granted. Section 25.114(c)(9) requires space station applicants to
specify the arrangements for TT&C of their space stations. DIRECTV states that it will conduct
TT&C operations from a remote site, but has not yet chosen the site(s). As a condition of this
waiver, DIRECTV must file a letter to the Chief, Satellite Division, International Bureau, no

later than 10 business days after the completion of Critical Design Review, specifying the
addresses and telephone numbers of its TT&C earth stations.

    6. DIRECTV‘s authorization for a 12/14 GHz FSS space station at the 79° W.L. orbital
location will be null and void with no further action on the Commission‘s part if the space station
is not constructed, launched, and placed into operation in accordance with the technical
parameters and terms and conditions of this authorization by these specified time periods
following the date of authorization:

                  Execute a binding contract for construction within one year (July 12, 2013);

                  Complete the Critical Design Review within two years (July 12, 2014);
                  Commence construction within three years (July 12, 2015);
                  Launch and begin operations within five years (July 12, 2017); and
                  DIRECTV must file a bond with the Commission in the amount of $3 million,
                  pursuant to the procedures set forth in Public Notice, DA—03—2602, 18 FCC Red
                  16283 (2003), within 30 days of the date of this grant (August 11, 2012).

    7. The license term for the DIRECTV KU—79W space station, Call Sign $2861, is 15 years
and will begin to run on the date that DIRECTV certifies to the Commission that the satellite has
been successfully placed into orbit and its operations fully conform to the terms and conditions
of this authorization. DIRECTV is directed to file its certification with the Chief, Satellite
Division, International Bureau, within 10 days after the space station commences operations at
its assigned location.

    8. DIRECTV is afforded 30 days from the date of release of this grant and authorization to
decline this authorization as conditioned. Failure to respond within this period will constitute
formal acceptance of the authorization as conditioned.

    9. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated
authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration under
Section 1.106 or applications for review under Section 1.115 of the Commission‘s rules, 47
C.F.R. §§ 1.106, 1.115, may be filed within 30 days from the date of the public notice indicating
that this action was taken.

             MINOR AMENDMENT TO DIRECTV KU—79W APPLICATION

        DIRECTV Enterprises, LLC ("DIRECTV") has filed an application for authority

to launch and operate a Ku—band satellite in the Fixed Satellite Service at the nominal 79°

W.L. orbital location, to be designated as DIRECTV KU—79W.‘ In this Application,

DIRECTV submits minor amendments to correct a few clerical errors in its original

application, including a revised Schedule S that incorporates all such corrections. In

accordance with Section 25.117(d)(1) of the Commission‘s rules, DIRECTV identifies in

this Application only those items of information that should be changed from its original

application. DIRECTV hereby certifies that the remaining information in its original

application has not changed.

        1.      TT&C Frequencies

        In the Schedule S filed with its original application, DIRECTV specified that

telemetry would be transmitted on two frequencies: 11724 MHz and 11725 MHz. Those

frequencies fall within one of the satellite‘s communications transponders. The correct

frequencies are 11704 MHz and 11705 MHz, as shown on the revised Schedule S

attached hereto. DIRECTV notes that the TT&C link budget submitted as Exhibit C to

its application narrative used one of the correct telemetry frequencies (11705 MHz).

       2.       Antenna Gain Contour

       The original antenna gain contour pattern for the Mexico beam submitted in .gxt

format did not include a —8 dB contour. The revised Schedule S attached hereto includes

a new .gxt file that includes the —8dB contour for that beam.

        3.      Solar Array

        The original application indicated that the area of the satellite‘s solar array would

be 13 m*. This figure is erroneous, as it relates to only a single wing of the solar array.

The revised Schedule S attached hereto reflects the correct value of 26 m for both wings

of the array.

        4.      Remote Location for TT&C — Requestfor Waiver

        In the Schedule S accompanying its original application, DIRECTV indicated that

it planned to operate the satellite by remote control, but did not provide further

information related to the remote control point. However, as DIRECTV stated in its

original narrative application, it "has not yet contracted for the construction of the

DIRECTV KU—79IW satellite, and therefore has not yet finalized arrangements for

tracking, telemetry and control." (Application Narrative at 10.) In these circumstances,

DIRECTV is unable to provide the contact information for the remote control point

requested in Schedule S.

        Accordingly, to the extent necessary, DIRECTV requests a waiver of the

requirement to submit such information. The Commission may waive its rules for good

cause shown," or where the particular facts make strict compliance inconsistent with the

public interest." At this very early stage, DIRECTV knows that it will conduct TT&C

operations for this satellite from a remote site, but does not know any details related those

TT&C operations. Accordingly, in this case, there is no way to provide the information

requested.

        Were the Commission to delay or deny the application for lack of such

information, it would unnecessarily require satellrite applicants to finalize all

arrangements for TT&C years before launch of a new satellite— in fact, before the

satellite authorization is even granted. This could significantly delay or deny the

provision of valuable satellite services to the public. There can be no realistic concern

that the inability to provide specific information on TT&C arrangements at this early

stage could affect ultimate operations of the satellite. DIRECTV operates a fleet of

satellites, and clearly will arrange for TT&C of DIRECTV KU—97W well in advance of

launching the satellite just as it has done for its many other satellites. At that point,

DIRECTV will be in a position to supply the information requested by Schedule S. At

present, however, DIRECTV respectfully requests that the Commission waive any

requirement for submission of information on the remote control site for TT&C and

continue to process the application to completion as expeditiously as possible.
