Dear Ms. Dortch:

This is to inform you that Christopher Putala of PutalaStrategies on behalf of Spectrum
Five, LLC ("Spectrum Five") had phone conversations on February 6, 2009 with
Commissioner Adelstein and on February 9, 2009 with Commissioner Adelstein, Paul
Murray of Acting Chairman Copps® office and Renee Roland Crittendon of
Commissioner Adelstein‘s office to discuss Spectrum Five‘s above—referenced petition
for a declaratory ruling to provide service from the nominal 103°   W.L. orbital
location using the 17/24 GHZ Broadcast—Satellite Service ("BSS"), and the International
Bureau‘s January 16, 2009 order dismissing the petition of DIRECTV Enterprises LLC to
provide service from this orbital location.‘ Mr. Putala‘s comments were consistent with
the arguments raised in Spectrum Five‘s petition.

Pursuant to Section 1.1206(b)(2) of the Commission‘s rules, two copies of this letter are
being filed for inclusion in each of the above—noted proceedings.
