The application of Mobile Satellite Ventures Subsidiary LLC (MSV) to modify its license for
operation of the MSV—1 space station, IBFS File No. SAT—MOD—20070117—00012, as amended
by SAT—AMD—20070508—00069, IS GRANTED. Accordingly, the license for the MSV—1 space
station — which authorizes operation at 101.3° W.L. using spectrum in the 1525—1544/1545—1559
MHz (space—to—Earth) and 1626.5—1645.5/1646.5—1660.5 MHz (Earth—to—space) frequency bands
for service links and using the 10.7—10.95/11.2—11.45 GHz (space—to—Earth) and 12.75—13.25 GHz
(Earth—to—space) bands for feeder links and telemetry, tracking, and control (TT&C) — IS
MODIFIED as proposed in the above—captioned amended application. Accordingly, inter alia,
MSV is authorized to transmit command signals to MSV—1 at 12.751 GHz and 13.249 GHz,
transmit telemetry signals from MSV—1 at 11.201 GHz and 11.202 GHz, and transmit power
control beacons from MSV—1 at 11446.25 MHz and 11448.75 MHz.
    1.   The modified authorization for MSV—1 is subject to the previously—established license
         conditions, except that the condition in Paragraph 65 of the original MSV—1 Order and
         Authorization, 20 FCC Red 9752 (Int‘l Bur. 2005), is revised to permit feeder—link and
         TT&C transmissions between MSV—1 and two gateway earth stations to be located in
         California and Texas, rather than in Virginia.
   2.    MSV‘s request for waiver of Section 25.210(i) of the Commission‘s rules, 47 C.F.R. §
         25.210(i), IS GRANTED. Section 25.210(i) directs, "Space station antennas in the
         Fixed—Satellite Service must be designed to provide a cross—polarization isolation such
         that the ratio of the on axis co—polar gain to the crosspolar gain of the antenna in the
         assigned frequency band shall be at least 30 dB within its primary coverage area." MSV
         indicates that MSV—1 will operate with a 25 dB cross—polarization isolation in the
         Appendix 30B Ku—band with the primary coverage area of the antenna for feeder link,
         command, telemetry, and power control beam operations. MSV indicates that there is no
         other satellite using these bands within 5 degrees other than MSV‘s AMSC—1 satellite.
         Accordingly, we find that these shortfalls will not produce a significant increase in
         interference, except to MSV itself, and will not adversely affect any other U.S. or
         foreign—licensed operator serving the United States. This waiver is granted with the
         condition that operation of the MSV—1 satellite in the Appendix 30B Ku—band shall not
         cause more interference to U.S. services being provided by any authorized system that is
         two—degree spacing compliant than would be caused if such operation were in compliance
         with Section 25.210(i). Further, MSV shall not claim protection against interference to
         its operations caused by U.S. services being provided by two—degree spacing compliant
         satellites if such interference results from the MSV—1 satellite‘s noncompliance with
         Section 25.210(i) of the Commission‘s rules, 47 C.F.R. § 25.210(i).
   3.    MSV‘s request for partial waiver of Section 25.114(c)(4)(i1), (¢){4)(iii), (c)(4)(v) and
         (c)(4)(vi) of the Commission‘s rules, 47 C.E.R. § 25.114(c)(4)(ii), (c)(4)(iii), and
         (c)(4)(v) (c)(4)(vi), IS GRANTED. In particular, MSV seeks to provide representative
         configurations in Schedule S, Tables S6 through $10 and Table S13, in lieu of all the
         information required by the rules. MSV indicates that the satellite will utilize ground
         based beam forming and, accordingly, will have the ability to form up to 500 L band spot
         beams, or to form a large number of L band spot beams in a portion of MSV‘s spectrum


and simultaneously form a smaller number of larger beams in another portion of the
spectrum. Given the great number of possible MSV—1 spot beam configurations and
transponders, we find that requiring submission of exhaustive specifications would be
unduly burdensome in this instance and the information provided by MSV as
representative taken together with the other information in the application as a whole is
acceptable in this instance.
This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated
authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration
under Section 1.106 or applications for review under Section 1.115 of the Commission‘s
rules, 47 C.F.R. §§ 1.106 and 1.115, may be filed within 30 days of the date of the public
notice announcing this action.
